258 month Anno Dom One thousand Seven hundred and twenty Nine being the day of the return of the Said Writt Cometh the said Benjamin Marchant by his attorney afd and the Sher of Somersett County to whom the foregoeing writt was directed Likewise Comes and makes Returne thereof to the Court here Endorsed in these words Following viz.t Cepi Corpus P John Purnall sher Whereupon the said sherr altho' Solemnly Called brings not in the body of the afd Isaac Fleming according to the return of his writt in the plea afd at which day the said Sherr present here in Court prays day ^Liberty^ till next Court to being in y.e said Isaac Fleming to answer &.c which is to him Granted and the Same day is Given to the afd Plft here also &c Att which said next Court to witt the Eighteenth day of November Anno Dom One thousand Seven hundred and Twenty Nine Came againe the afd Benjamin Marchant by his attorney afd and the same Sher altho' at the Same day being againe Solemnly Called brings not in y.e Body of the afd Benjamin March Isaac Fleming At which day the said Sherr present here in Court prays ^further Liberty^ day till next Court to bring in y.e said Isaac Fleming to answer &.c which is to him granted &.c and the Same day is Given to the afd Plft here also &.c Att which said Next Court to witt the seventeenth day of March Anno Dom One thousand Seven hundred and Twenty Nine Came againe the afd Benjamin Marchant by his attorney afd and the Same Sher of the Same day altho' Solemnly Called brings not in the body of the said Isaac Fleming but makes default &.c Whereupon the afd Benjamin Marchant by his attorney afd prays that the Same Sherr may be amerced the afd two pounds four Shillings Currant mony and all the Costs and Charges that did accrew by means of the prosecution of the action afd Wherefore it is Considered by the Court here that the afd Sher to witt John Purnall be amerced for his Contempt afd the afd two pounds four shillings Currant Money and Five hundred and seven Eight pounds of tobacco by the Court adjudged for ^the^ Costs and Charges accrewed on prosecution of said Suit &c
And the afd Moses Chaille by francis Allen his attorney Complaines against the afd John Blizard in the plea afd as followeth vizt Somerset County ss John Blizard late of Somerset County planter was attached to answer unto Moses Chaille Jun.r of a plea of trespass upon the Case &.c And whereupon the Said Moses by Francis Allen His Attorney Complains that Whareas the Said John the first day of Nov.r Anno Dom Seventeen Hundred & twenty Nine at Somrsett County within the Jur of this Court was Indebted unto the S.d Moses in thirty Eight Shillings & three Pence Currant Mony of Maryland for Sundry Goods wares & Merchandizes by the S.d Moses in thirty Eight Shillings & three Pence Currant Being So thareof Indebted the S.d Jn.o in Consideration there of upon him Selfe did Assume and to the S.d Moses faithfully did Promisse the he the Said Jn.o the Said thirty Eight Shillings & three pence to the Said Moses when he Should be thereunto requested he would well & faithfully pay & Content Nevertheless the Said John his promisse & Assumption af.d in forme af.d made Not regarding but Ploting & fraudulently Intending the S.d Moses in that Pte craftilly & subtilly to Deceive and Defraud tho Often requested the Said thirty Eight |
