against him hath Decleared &c

             Therefore it is Considered by the Court that the afd Francis Allen recover against the
afd William Groomes Eight thousand pounds of tob.o his Debt afd and ^his^ Damages by Occasion
340    of the Detaining of the same Debt to three hundred and forty            pd.s of tob.o to the
Same Francis of his assent by the Court here adjudged and the afd Deft in Mercy &.c whereupon
the afd Francis by his attorney afd gratis here in Court Remitteth to the afd W.m the
afd Eight thousand pounds of tobo  therefore it is Considered that the afd William of the afd
Eight thousand pounds of tob.o be acquitt &c

Bishop Jun.r of Somrsett Co.ty Planter was Sumoned to answer unto Francis
Allen Sher of a plea that he render unto him Eight Thousand pd.s of Tob.o which
                      to him he owes and from him he Unjustly Detaines &c

And whereupon the same Francis Allen by Levin Gale his attry saith that whereas ye afd John
Bishop Jun.r the second day of Decem: Anno Dom one thousand seven hundred & twenty Six at
Somrsett Co.ty within the Jur of this Court by his Certain Writing Obligatory Granted himselfe to
be held and firmly bound unto ye same Francis in ye sum of Eight Thousand pd.s of good Merchantable
Tob.o to be paid the same Francis when afterwards ye said Jn.o Bishop Jun.r ye same
hitherto to doe hath altogether Denyed and still doth Deny & Unjustly Detain whereby
the same Francis sayes he is worse & hath Dam to ye value of Sixteen thousand pd.s of
Tob.o & thereof he Brings this suite ye    And the same Francis Allen brings here into Court
the Writing obligatory afd which the Debt afd in form afd Witnesseth Whose Date is the
Same Day and Year afd            L: Gale P Quer Pledges &.a Jno Doe  Richd Roe

    And the afd Jn.o BIshop Jun.r by Geo: Dashiell his attry Comes and Defends the force and
Injury When &a                              And prays Leave to Imparle hereunto untill ye Next Court
and he hath it & ye same day is given ^unto^ to the afd Plft here also &a

    Att which said Next Court to witt the fifteenth day of August Ann.o Dom one thousand seven
hundred and twenty seven Came again as well ye afd Francis Allen as ye afd Jn.o Bishop Jun.r
by their attys afd & whereupon the said Jn.o Bishop Jun.r by his said attry as before Defendes
the force and Injury ^when^ &c   And says yt he Cannot gainsay ye action of ye afd Francis nor but yt ye
Writing Obligatory afd is the act & Deed of ye same Jn.o Bishop Jun.r nor but that he owes the afd
Francis the afd Eight Thousand pd.s of Tob.o in Manner & form as the afd Francis above against
him hath Declared &c

    Therefore it is Considered by ye Court yt ye afd Francis Allen recover against the afd Jn.o
Bishop Jun.r Eight Thousand pd.s of Tob.o his Debt afd & his Damages by Occasion of the
350   Detaining of the same Debt to three hundred and fifty                           pd.s of Tob.o
to ye same Francis of his assent by ye Court here adjudged & ye afd Deft in Mercy &a
                                    fees to Geo Tull
