164 twelve Shillings and four pence Curr.t mony And because the aforesaid Archibald denys not this but the same alligation Confesseth to be true prays Judgm.t and those damages above Confessed together with his costs and Charges aforesaid to him adjudged &c Therefore by Consent of the parties aforesaid it is Considered that the aforesaid Archibald Smith recover against the aforesaid David Robinson his damages aforesaid to the afd three pounds twelve Shillings and four pence Currant mony of Maryland by the same David Robinson in form afd Confessed as also two hundred and Eighty Seven pounds of tobacco for his Costs and Charges to the same Archibald at his request by the Court here and Consent of the parties afd adjudged which Certain damages in the whole do amount to three pounds twelve shillings and four pence Curr.t mony of Maryland and two hundred and eighty seven pounds of tobacco and ye aforesaid deft in mercy &c
Whereupon the said William West being Called appears and thereupon the said William West at the prayer of the Said William Hopkins by francis Allen his attorney is adjudged to give speciall bail to the action aforesaid Thereupon a Certain Randall West of Somersett County planter present herein Court in his proper person undertakes for the said William West that if in Case the said William Hopkins shall Recover Judgmt in the plea aforesaid against the said William West or that the said William West should be therein convict that then he the said William West Shall pay the Condemnation of the Court thereupon or render his body to the Custody of the sher of Somersett County in satisfaction thereof or that he the said Randall West will do it for him &c Whereupon the said William West by Levin Gale his attorney appears and Imparles till next Court &c
County within the Jurisdiction of this Court with force and arms a Certain Horse of the Same Johns of the price of twelve pounds currant mony with a Gun Charged with powder and shott did sho by means whereof the said Horse did dye and other harms to the said horse then and there did do to the great damage of the Same John and against the peace &c whereby the same John Says he is worse and hath damage to the value of Twenty pounds Curr mony & thereof he brings this suite &.c L Gale P Quer Pledgs Jno Doe Richd Roe And The said Thomas Billings by George Dashiell his attorney Comes and defends the force and Injury |
