hundred and twenty Six pounds of tobacco to the Said Joseph he hath not paid or to him for
the Same in anywise Contented altho' the Same to do the Said Alexander by the Said Joseph on the
first day of August Anno Dom One thousand Seven hundred and twenty five and often afterwards
at the County afd within the Jurisdiction afd he was thereunto requested but the Same
to him to pay or in any wise to Content hath Refused and Still doth Refuse and deny whereupon
the Said Joseph saith he is worse and hath damage to the value of Eight^een^ hundred and fifty
two pounds of tobacco and thereupon he brings this Suite &c    Levin Gale P Quer Pledgs Jno Do R Roe

          And whereupon the said Alexander Hudson being Called appears and thereupon the
Said Alexander Hudson at the prayer of the plfts attorney afd is adjudged to give Speciall
bail to the action afd thereupon a Certain Thomas Renchor of Somersett County planter present
here in Court undertakes for the Said Alexander Hudson that if in Case the Said Joseph Macclester
Shall recover Judgm.t in the plea afd against the said Alexander Hudson or that the Said
Alexander Hudson shall be therein Convict that then he the Said Alexander Hudson shall
pay the Condemnation of the Court thereupon or render his body to the Custody of the Sherr of
Somersett County in Satisfaction thereof or that the he the said Thomas Renchor will do it for him
       whereupon the said Alexander Hudson in his Own proper person Cometh and defendeth
the force and Injury when &c and Sayth that he Cannot gainsay the plft his action afd so as afd
against him brought nor Can he say but that the said plft Ought to recover his damages by occasion
of the premisses afd to Nine hundred and twenty six pounds of tobacco and Costs of Suite against him
which the said plft doth not Gainsay &c

                            Therefore it is Considered by the Justices here the Sixteenth day of Novem
Ann Dom One thousand Seven hundred and twenty five that the afd Joseph Macclester Recover
against the afd Alexander Hudson his damages by Occasion of the premisses afd in form afd Confesed
to the Sum of Nine hundred & twenty Six pounds of tobo as also the Sum of three hundred and
twenty Seven                  pounds of tobacco by the Court here adjudged unto him for his Costs and Charges
by him about his suite in this Behalfe Laid Out & Expended & ye afd deft in Mercy &c
