1725 58 Maryland fs Know all men by these presents that We William Walton, Henry Alexander and Nathaniel Wale all of Somersett County in the province afd are holden and firmly Bound unto John, Eward Ebenezer, Elizabeth and Saml Evans's Orphans of John Evans dec.d in the full and Just Sum of two hundred Eighty three pounds Curr.t money to be paid unto the Said John, Edward, Ebenezer Elizabeth and Samuel Evans's orphans as afd their heirs Executors ^adm.rs^ or assigns to the which paym.t well and truely to be made and done we bind Our Selves our and Either of Our heirs Executors and adm.rs for the whole and in the whole Joyntly and Severally firmly by these presents sealed with our Seals and dated the 17.th day of august ann Dom 1725 The Condition of the above obligation is such that if the above bound William Walton Henry Alexander and Nathaniel Wale their heirs Executors or administrators do well and truely pay or Cause to be paid unto the above Said John, Edward, Ebenezer, Elizabeth and Samuel Evans orphans as afd their heirs Executors adm.rs or assignes the full and Just Sum of One hundred and forty One pounds ten Shillings Curr.t money to be paid them according to Law and the will of the Said deceased when they shall attain to full years then the above Obligation to be void Otherwise to remain in full force & vertue in Law W.m Walton (seal) Sealed and delivered In presence of Henry Alexander (seal) Edmond Hough Nathaniel Wale (seal) Jos: Dashiell
he unjustly detaineth &c And whereupon the same Thomas by Levin Gale his attorney Complains that whereas the Said William the tenth day of June ann Dom seventeen hundred and fifteen at Somersett County afd within the Jurisdiction of this Court by his Certain Writing Obligatory granted himselfe to be held and firmly Bound to the Same Thomas in the sum of one thousand and twenty four pounds of tobacco to be paid the same Thomas when afterwards he Should be thereto Required Nevertheless the said William altho' often thereto Required he the Said Sum of one thousand and twenty four pounds of tobacco or any part thereof to the said Thomas hath not Rendered but he the same hitherto to Render hath altogether denyed and still doth deny and unjustly detaine &c to the damage of the said Thomas two thousand pounds of tob.o and the Said Thomas Bringeth hereinto Court the Writting &c by which &c L Gale P Qur Pledges &c Jno Doe R Roe And the said William Timmons being present in Court is adjudged to give Speciall Bail to the action afd but for want thereof the Said William Timmons is Committed into the Custody of the Sherr of (Somersett) |
