1727 272 Maryland avalon Lord Baltemore &.a To ye Sher of Somrsett Co.ty Greeting whereas Benj.a Wailes Lately in our County Court of Somrsett here to to witt ye Eighteenth day of June Anno Dom one thousand Seven hundred & Nineteen before Charles Ballard Gent & his associates then our Justices of ye Same Court at Dividing Creek & by Consideration of the Same Court recovered against W.m Timmons Late of Somrsett Co.ty Planter Seven hundred & twenty Nine pd.s of Tob.o w.ch were adjudged for his Dam.s which he Sustained as well by occasion of the Nonperformance of a Certain promise to ye Same Benj.a by the afd W.m Timmons made as for his Costs & Charges by him about his Suite in that part expended whereof he is Convict as by the record & proceedings thereof in our Court before our Justices at Dividing Creek now remaining Manifestly appeareth Notwithstanding Execution of the Judgm.t afd as yett remained to be made as by the Insinuation of the afd Benj.a we have received & because we are willing that which in our Court afd is ritefully acted shold be duely Executed we Command you yt by good & Lawfull men of your Bailywick you Make Known to ye afd W.m Timmons yt he be & appear before our Justices of our County Court to be held at Dividing Creek in ye County afd ye third tuesday of June Next to shew Cause if yt anything for himselfe he hath or to say Knoweth wherefore the afd Benj.a Wailes Execution ag.t him of ye Dam.s & Costs afd to have ought not according to ye forme of ye recovery afd if to him it Seemeth Expedient & have you there then ye Names of those by whom you make ye same Known & this Writt Wittness Att which said third tuesday of June to witt the twentieth day of the Same month Anno Dom Dom One thousand Seven hundred and twenty Seven being the day of the Return of the said Writt Came the afd Benjamin Wailes by his attorney afd and the sher of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following vizt made known P Francis Allen sher And the afd William Timmons altho' so ^before^ warned being Solemnly Called Cometh not but maketh default Therefore it is Considered that the afd Benjamin Wailes have his Execution against the afd William Timons of Seven hundred and twenty Nine pounds of tobacco his damages afd as 261 Two hundred & sixty one pounds of tobacco to the same Benjamin by the Court here adjudged according to the form of the Statute thereof Lately made and provided for his Costs and Damages Sustained by Occasion of Delay of Execution of the Damages afd
