248 he Cause to Come here twelve &c by whom &c who neither &c ^to recognize &c^ because as well &c of which said Preceipt the said sherr to witt Francis Allen Gent now hereat this day to witt the twenty first day of march anno Dom One thousand seven hundred and twenty six Cometh and maketh Return thereof to the Court that he hath here Ready twelve &c as by his said Preceipt he was Commanded And nowhere afterwards to witt the same day and year Came as well the afd Plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt Charles Cottingham, John Donelson, Christopher Glass, William McClammey, Isaac Marshall David Hudson, Edward Beachamp, And.w Collins, Giddion Tilman, Mathew Purnall Henry Allexander Thomas Billings who being duely Elected tryed and sworn to say the truth in the premisses upon their Oath do say that the afd John Holder did upon himselfe assume in Manner and form as the afd Henry above against him hath Complained an did assess the damages of the same Plft by occasion of the non performance of the promise and assumption afd besides his Costs and Charges by him about his Suite in that Part Expended to four pounds twelve shillings & six pence Curr.t mony and for those Costs and Charges to one pounds of tobacco Therefore it is Considered that the afd Henry Toadvine Recover against the afd John Holder his dam four pounds Twelve shillings and six pence and one pounds of tobacco his damages afd by the Jurors afd in form afd assessed as also seven hundred and Seventy Two pounds of tobacco for his Costs and Charges to the same Henry by the Court hereof his assent of Increase adjudged which Certain Damages in the whole do amount to four pounds twelve shill and six pence Curr.t money and seven hundred and seventy three pounds of tobacco and the afd deft in mercy &c
Ann.o Dom one thousand seven hundred and twenty five at Somersett County within the Jurisdiction of this Court was Indebted unto the afd Thomas in the Sum of five pounds and six pence Curr.t money as by acc.o herewithin Court produced may appear and so thereof being Indebted the same John in Consideration thereof afterwards to witt the same day and year afd at the County afd within the ^afd^ Jur of th upon himselfe assumed and to the same Tho.s then and there faithfully promised that he when afterwards he should be thereto requested the afd sum of five pounds and Six pence Curr.t money to the Same Tho.s ^would^ well and faithfully Content (and) |
