        A Copy of ye foregoing Decl.n & acc.t were made & sent to be served on ye afd John
Purnall Jun.r with ye Writt in the plea afd &c

            Att which said third tuesday of March next to witt ye twenty first day of
ye same Month anno Dom one thousand seven hundred & twenty ^six^ being ye day of ye
return of ye said Writt Cometh ye afd Theod.s Bere by his attry afd & ye sher of
Somrsett County to whome ye foregoing Writt was Directed Likewise Cometh &
Maketh return thereof to ye Court here Endorsed in these words following
vizt                              Cepi Corpus Decl.n Delivered in time p me Fran Allen Sher

       Whereupon ye afd Jn.o Purnall Junr in his own proper person Comes & Defends
ye force & Injury when &a & saith yt he Cannot gainsay ye action afd nor but yt he
Did assume upon himselfe in Manner & forme as ye afd Theodorus Bere above agt
him hath Complained nor Can he say but yt ye afd Theods Bere hath sustained Dam
by occasion of ye Non performance of his promisse & assumption afd too Nine hundred
& fifty two pd.s of Tobo & ye same Decl.n in all ye sd words ^before^ Expressly Confesseth &a

          Therefore it is Considered yt ye said Theod.s Bere recover against ye afd Jn.o Purnall Jun.r
as well ye sum of Nine hundred & fifty two pd.s of Tob.o his Damages afd by him in his
Decl.n above supposed as also ye sum of three hundred and Eleven p
pounds of Tob.o for his Costs & Charges by him about his suite in yt part Expended
to ye same Theodorus by ye Court here of his assent adjudged & ye afd Deft in Mercy &c

Dennis Folio Late of Somrsett County Blacksmith if he should
                      be found in his Bailywick & him should safe Keep so yt he might have his Body

       ye third tuesday of March then Next to answer unto Jn.o Evans Junr of a plea yt he render
       unto him one thousand pd.s of Tobo & Casque which to him he ows & unjustly detaines &c
