afd in forme afd made Little regarding & plotting & fraudulently Intending him ye
said Jos: in yt part Craftilly & subtilly to defraud & Deceive he ye afd sum of eight
hundred & Sixty three pounds of tobacco or any part thereof unto the Same Joseph
(altho' afterwards to witt the Same day and year afd at the County afd within the
afd Jurisdiction he was thereto Requested) he hath not paid or the same Joseph
for it in any wise Contented but the said James the same hitherto to do hath
altogether Refused and still doth Refuse to the damage of the Same Joseph
seventeen hundred and twenty six pounds of tobacco and thereof he brings this Suite &a

A Copy of the foregoeing declaration and account were made and sent to be served
on the aforesaid James Russell with the writt in the plea afd &c

             Att which said third tuesday of march ^to witt the twenty first day of the same month^ Anno Dom one thousand seven
hundred and twenty six being the day of the Return of the afd writt Cometh the afd
Joseph MccClester by his attorney afd and the sherr of Somersett County to whom
the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the
Court here Endorsed in these words followeth viz.t Cepi Corpus decl delivered in time
                                                                                              p Francis Allen sherr

    And the afd James Russell by George Dashiell his attorney Comes and defends the
force and Injury when &.c and the same attorney sayth that he is not Informed by the
same James his Clyant of any answer for the same James to the afd Joseph MccClester
in the plea afd to be given and nothing Els thereof says by which the same Joseph Remaineth
against the afd James thereof undefended &c

          Wherefore the afd Joseph his damages by occasion of the Non performance of the
promise and assumption afd against the afd James Ought to Recover &c

          And whereupon at the prayer of the afd Joseph Macclester and by the Consent of the afd
James Russell the Justices here according to act of assembly in Such Case made and provided did
