   Michael Holland
     Command was given to the Sher of Somrsett County yt he should take
Michael Holland Late of Somrsett County Marriner if he should
                       be found in his Bailywick & him should safe Keep so yt he might have his
    Body before the Justices of his Lordships County Court of Somrsett to be held at
    Dividing Creek ye third tuesday of March then next to answer unto Jos MaClester
    of a plea of Trespass upon the Case &.c & that thereof he should not fail &a

             And the afd Jos: MaClester by Levin Gale his attry Declared against the afd
    Michael Holland in the plea afd as followeth vizt

Somrsett fs   Michael Holland sen.r Late of Somrsett County Marriner was attached to
          answer unto Jos: MaClester of a plea of Trespass upon ye Case &a

    And Whereupon ye sd Jos: by Levin Gale his attry Complaines yt whereas the said
    Michael the first day of Novem Seventeen hundred & twenty six at Somrsett County afd
    within the Jur of this Court was Indebted unto the said Jos: in sixteen hundred thirty
    Eight pd.s of Tob.o as by acc.t hereunto annexed may appear & being so thereof
    Indebted the said Michael in Consideration thereof the day & year afd at ye place
    afd upon himselfe did assume & to ye said Jos: then & there did faithfully promisse
    that he the said Michael the said Sixteen hundred thirty Eight pounds of Tob.o to
    the said Jos: when he should be thereunto requested he would well & faithfully pay
    and Content & altho' the said Michael Nine hundred seventy three pounds of Tob.o
    Pcell of the said Debt to ye sd Jos: he hath paid & satisfied yett as to ye residue thereof
    being Six hundred sixty & five Pounds of Tob.o the said Michael his promisse &
    assumption afd in forme afd made Nothing regarding but plotting & fraudulently
    Intending the said Jos: in yt part Craftilly & subtilly to deceive & Defraud ye said
    Six hundred Sixty & Five pounds of Tob.o to the said Jos: hath not paid altho' the
    same to doe ye sd Michael was often thereunto requested but ye same to him hitherto to
    pay hath refused & still doth refuse & Deny to ye Dam of ye sd Jos: of thirteen hundred pd.s
    of Tob.o & thereupon he Brings Suite &a                  L Gale P Quer pledges &.c J Doe R: Roe
