                 March Court        1726                     239

West in the plea afd as followeth viz.t             Somersett fs   Randall West Late of somerset County
Planter was attached to answer unto Joseph MccClester of a plea of trespass upon the Case &c

       And whereupon the said Joseph by Levin Gale his attorney Complains that whereas the
afd Randell ye tenth day of Novem.r anno Dom one thousand seven hundred & twenty
six at Somrsett County within ye Jur of this Court was Indebted to ye afd Jos in ye sum
of Two thousand five hundred & eleven pd.s of Tob.o as by acc.t herewith in Court produced may
appear & so thereof being Indebted ye said Randell in Consideration thereof afterwards
to witt the same day & year afd at the County afd & within the afd Jur upon himselfe
assumed & to the same Jos: then & there faithfully promissed yt he when afterwards
he should be thereto requested he ye afd Sum of Two thousand Five Hundred & Eleven pds
of Tob.o unto ye same Jos wou'd well & faithfully Content & pay Nevertheless ye sd
Randell his promisse & assumption afd in form afd made Not regarding but plotting and
fraudulently Intending him ye said Jos in yt part Craftilly & Subtilly to Defraud & deceive
he ye afd Sum of Two thousand Five hundred & Eleven pd.s of Tob.o or any part thereof to ye
Same Jos (altho' afterwards to witt ye same day & year afd at ye County afd & within ye
afd Jur he was thereunto requested) hath not paid or him for it in anywise Contented but
ye said randell ye same Hitherto to Doe hath altogether refused & Still doth refuse & deny to
the dam of ye same Jos: three thousand pounds of Tob.o & thereof he Brings this suite &c
