of his promise and assumption afd to one thousand and Twenty two pounds of tobacco and
the same declaration in all the words before Expressly Confesseth &c

         Therefore it is Considered that the afd Joseph MccClester Recover against the afd Nathaniel
Whele One thousand and twenty two pounds of tob.o his damages afd by him in his declaration
257   above supposed as also the sum of Two hundred and fifty seven                  pounds of
tobacco for his Costs and Charges by him about his suite in that part Expended to the Same Joseph by
the Court here of his assent adjudged and the afd deft in mercy &c

 Command was given to the Sherr of Somersett County that he should take Abraham
Mason Late of Somersett County Planter if he Should be found in his bayliwick
and him Should Safe keep so that he might have his body before the Justices
of his Lordships County Court of Somrsett to be held at Dividing Creek
                      the third tuesday of March then Nextto answer unto Jos: MaClester of a plea
of Trespass upon the Case &a and that thereof he should not fail &a

    And the afd Joseph MaClester by Levin Gale his attry Proceeded against ye sd Abraham
Mason in the plea afd as followeth vizt

Somrsett fs   Abraham Mason Late of Somrsett County Planter was attached to answer
                unto Jos MaClester of a plea of Trespass upon the Case &a

And whereupon ye sd Jos by Levin Gale his attry Complaines yt whereas the said Abraham
ye first day of Novem.r Anno Dom one thousand Seven hundred & twenty six
at Somrsett County afd within ye Jur of this Court was Indebted unto ye afd Jos in two
thousand two hundred & twenty one pd.s of Tob.o as by acc.t hereunto annexed may appear
& being so thereof Indebted the said Abraham in Consideration thereof the day & year
afd at ye place afd upon himselfe did assume & to the said Jos then & there did faithfully
promisse yt he ye said Abraham ye said two thousand two hundred & twenty one pd.s of
Tob.o to ye said Joseph when he should be thereunto requested he would well and
faithfully pay & Content & altho' ye said Abraham six hundred & Eleven pounds
of Tob.o Pcell of the said Debt to ye said Joseph he hath paid & satisfied yett as to ye
residue thereof being one thousand six hundred & ten pd.s of Tob.o ye sd Abraham
his promisse & assumption afd in forme afd Made Nothing regarding but plotting
& fraudulently Intending ye Said Jos in yt part Craftilly & Subtilly to Deceive and
Defraud ye sd one thousand Six hundred & ten pd.s of Tob.o to ye sd Jos hath not paid
altho' the same to doe hath refused & still doth refuse & deny to the dam of ye said
Jos of three thousand two hundred & twenty pd.s of Tob.o & thereupon he Brings
