upon the Case &a      And whereupon ye sd Jos: by Levin Gale his attry Complaines
that whereas ye said Mary ye first day of Novem Anno Dom one thousand seven
hundred & twenty Six at Somrsett County afd within ye Jur of this Court was Indebted
unto ye sd Jos: in Eight hundred & Seven pounds of Tob.o as by acct hereunto annexed
may appear and being so thereof Indebted ye Said Mary in Consideration
thereof the day & year afd at ye place afd upon herselfe did assume & to ye sd Jos:
then & there did faithfully promisse yt She the said Mary ye sd Eight hundred
& Seven pd.s of Tob.o to ye sd Joseph where She should be thereunto requested
She would well & faithfully pay & Content & altho ye sd Mary three hundred &
Nineteen pd.s of Tob.o Pcell of the said Debt to ye said Joseph She hath that she
paid & Satisfied yett as to ye residue thereof being four hundred & eighty eight
pd.s of Tob.o ye sd Mary her promisse & assumption afd in forme afd made
Nothing regarding but plotting & fraudulently Intending ye sd Joseph in
yt part Craftilly & Subtilly to deceive & Defraud ye sd four hundred & eighty
eight pd.s of Tob.o to ye sd Jos: hath not paid altho' ye sd Same to doe ye said
Mary was often thereunto requested but ye same to him hitherto to pay hath
refused & still doth refuse & Deny to the Damage of the said Joseph of Nine
hundred & Seventy Six pds of Tob.o & thereupon he Brings Suite &a

       A Copy of the foregoing Decl.n & acc.t were made & sent to be Served on ye afd
Mary Godwin with the Writt in the plea afd &a

       Att which said third tuesday of March to witt the twenty first day of the same
month anno Dom one thousand Seven hundred & twenty six being the day of
the return of the said Writt Cometh ye afd Jos: MaClester by his attry afd & the sherr
of Somrsett County to whome ye foregoing Writt was Directed Likewise Cometh
& Maketh return thereof to the Court here Endorsed in these Words following
vizt                               Cepi Corpus decln Delivered in time p me Fran Allen sherr

          And the said Mary Godwin being present here in Court is at ye prayer of the Plfts
attry afd adjudged to give Speciall Bayle to ye action afd thereupon a Certain Michael
Godwin Late of Somrsett County Planter present herein Court undertakes for ye
Said Mary Godwin yt if in Case ye afd Joseph MaClester Shall recover Judgm.t in ye
plea afd against the afd Mary Godwin or yt ye said Mary Godwin shall be therein
Convict yt then she ye said Mary Godwin shall pay the Condemnation of the Court
thereupon or render her Body to the Costody of the sher of Somrsett County in
satisfaction thereof or yt he ye said Michaell Godwin will do it for him her
&a      Whereupon ye afd Mary Godwin by Geo: Dashiell her attry Comes & defends
the force & Injury when &a   and saith yt he Cannot gainsay ye action afd nor
but yt she did assume upon herselfe in Manner in Manner & forme as ye afd Jos:
MaClester above against her hath Complained nor Can he say but yt ye afd Jos:
