John the first day of Novem Anno Dom one thousand Seven hundred and twenty six at Somersett
County afd within the Jurisdiction of this Court was Indebted unto the said Jos: in one thousand
two hundred and forty Seven pounds of tob.o as by acc.o hereunto annexed may appear and being so
thereof Indebted the said John in Consideration thereof the day and year afd at the place afd
upon himselfe did assume and to the said Jos then and there did faithfully promise y.t he ye said
John the said one thousand two hundred and forty seven pounds of tob.o to ye said Jos when he should
be thereunto Requested he would well and faithfully pay and Content altho the said John two
hundred and forty Seven pounds of tob.o percell of the said Debt to the said Jos he hath
paid and Satisfied yet as to the Residue thereof Being one thousand pounds of tob.o ye said Jn.o
his promise and assumption afd in forme afd made Nothing Regarding but plotting and
fraudulently Intending the said Jos in that part Craftilly and Subtilly to Deceive and defraud
the said one thousand pounds of tob.o to the said Jos hath not paid altho' the same to him
hitherto to pay hath Refused and Still doth Refuse and Deny to the Damage of the said Jos
of two thousand pounds of tob.o and thereupon he Brings suite &c   L Gale P Quer pledges &.c J Doe R Roe

       A Copy of ye foregoeing decl.n and acc.o were made and sent to be served on the afd Jno Phillips
with the writt in the plea afd &c

       Att which said third tuesday of march to wit the twenty first Day of the same Month
Anno Dom one thousand seven hundred and twenty Six being the day of the Return of the said
writt Cometh the afd Jos MccClester by his attorney afd and the Sherr of Somrsett County to whom
the foregoing writt was Directed Likewise Cometh and Maketh Return thereof to the Court
here Endorsed in these words following viz.t Cepi Corpus decl.n Delivered in time P Fran Allen Sherr

       Whereupon the afd John Phillips being Called appears and thereupon the afd Jn.o
Phillips at the prayer of the Plfts attorney afd is adjudged to give Speciall Bail to the Action
afd whereupon a Certain Thomas Gordan late of Somrsett County Planter present here in Court
undertakes for the said Jno Phillips that if in Case the afd Jos MccClester shall Recover
