         Whereupon the Said William Calvert in his own proper person appeared and thereupon
       the Said William Calvert at the prayer of the Plft is adjudged to give Speciall bail to the action afd
       thereupon a Certain William Holland of Somersett County Gent presept here in Court undertakes
       for the Said William Calvert that if in Case the Said Joseph MccClester Should recover
       Judgm.t in the plea afd against the Said William Calvert or that the Said Will.m Calvert
       Should be therein Convict that then he the Said William Calvert Shall pay the Condemnation
       of the Court thereupon or render his Body to the Custody of the Sherr of Somersett County in
       Satisfaction thereof or that he the Said William Holland will do it for him &c 
                And the Said William Calvert in his Own proper person Cometh and defendeth the
       force and Injury when &c and says that he Cannot gainsay but that he did assume upon himselfe
       in manner and form as the afd Plft above against him hath Complained nor but that the afd
       Plft ought to recover his Damages by Occasion of the Non performance of the Province and
       assumption afd to Nine hundred and Six pounds of tobo and Costs of Suite against him which
       the said Plft doth not gainsay

                      Therefore it is Considered by the Justices here that the afd Joseph Macclester Recover
       against the afd William Calvert as well the Sum of Nine hundred and Six pounds of tobo his Damages
256   afd In form afd Confessed as also the Sum of two hundred and Six                                      pounds
       of tob.o by the Court here for his Costs and Charges by him about his Suite in that part Expended and ye
       afd deft in Mercy &c

attached to answer unto Joseph MccClester of a plea of trespass upon the
                         Case &c    and whereupon the Same Joseph MccClester by Levin Gale his attorney
       Complaines that whereas the afd Thomas the tenth day of June ann Dom one thousand Seven
       hundred and twenty five at Somersett County afd within the Jurisdiction of this Court was Indebted
       unto the afd Joseph in the Sum of nine hundred seventy Eight pounds of tob.o as by acco.t herewith
