150 said John Caton by his attorney afd and thereupon he the said John Caton by his said attorney as before defends the force and Injury when &a and saith that he is not guilty of the premises above Imposed on him in manner and form as the Plft against him hath Complained and of this he putts himselfe upon the Country L Gale P Deft and the Plft likewise Dashiell thereupon Command was given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither to Recognize &c becaus as well &c of which said Preceipt the Said Sherr to witt Francis Allen Gent Now here at ^this day^ to witt the Same day and Year Last mentioned makes Return that he hath here Ready twelve &c as by his said preceipt he was Commanded and Now hereafterwards to witt the Same day and Year Came as well the afd Plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled ^being^ Called likewise Came to witt William Lane, Thomas Pullett, W.m Holland, Lewis Disharoon, Sam.l Taylor, Sam.l Tomelinson, Jos: Langford, Giddion Tilman, Adam Spence Robert Hall, Thomas Purnall and James Mumford who being duely Elected tryed and Sworn to say the truth in the premisses upon their Oath do Say that the Said John Caton is not guilty of the premisses as the plft above against him hath Complained Therefore it is Considered by the Justices here the Same day and Year Last mentioned that the afd Ebenezer Handy take nothing by his writt and declaration afd but be in Mercy for his falce Clamour and that the Said John Caton goe thereof without day &a And further it is Considered by the Same Court that the afd John Caton Recover against the afd Ebenezer Handy the Sum of six hundred and fifty Nine pounds of tobacco for his Costs and Charges by him about his defence in that Part Sustained ^to^ the same John by the Court adjudged according to the form of the Statute &a and that he have thereof his Execution &a
your worships that Care might be taken of the Estate of Levin Woollford of Somersett County dec.d which accordingly your worships appointed your Petitioner but as yett no view hath been made on the Reall Estate and that the Relict of the Said Levin Woolford is dec.d Leaving two orphans behind the One being in England the other here being a minor and not |
