150 And the afd Alexander Wordie by Levin Gale his attorney Cometh and defendeth the force and Injury when &c and prayeth Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd Plft also Att which said next Court to witt the twenty first day of June anno Dom One thousand Seven hundred and twenty Six Came again as well the afd Plft as the afd Deft by there attorneys afd and thereupon the Said deft by his attorney as before defends the force and Injury when &c and Says he is not guilty of the Premisses above upon him Imposed in manner and form as the afd John against him Complained and of this he putts himselfe upon the County &c L Gale P Def and the Plft Likewise G Dashiell P Quer Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to Recognize &c becaus as well &c of which Said Preceipt the Said Sherr to witt Francis Allen Gent Now hereat this day to witt the Same day and year Last mentioned makes Return that he has here Ready twelve &c as by his Said Preceipt he was Commanded and now hereafterwards to witt the Same day and year Comes as well the afd Plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt William Lane Thomas Pullett, Jacob Messix, Lewis Disharoon, Sam.l Taylor, Saml Tomelinson, Joseph Mumford ap who being duely Elected tryed and Sworn to Say the truth in the premisses afd upon their Oath do Say that the afd Alexander Wordie is guilty of the premisses as the the Plft above in manner and form hath declared against him and do assess the damages of the Same Plft besides his Costs and Charges by him about his Suite in this behalfe Laid Out and Expended to four pounds Curr.t mony and for those Costs and Charges to One pounds of tobo Therefore it is Considered by the Court here the Same day and Year Last mentioned that the afd John Milbourn Recover against the afd Alexander Wordie as well the Sum of four pounds Curr.t money and One pounds of tobo his damages afd in (725) form afd by the Jurors assessed as also the Sum of Seven hundred and Twenty five pounds of tobo by to the same John Milbourn at his Request for his Costs and Charges afd by the Court here of Increass adjudged and the afd Deft in Mercy &c Whereupon the afd Alexander Wordie by his attorney afd prays the Court that they may (According) |
