afd Jacob the tenth day of August Seventeen hundred & twenty three at ye County afd within ye Jur: of this Court was Indebted unto ye afd John In ye Sum of two pound twelve Shillings and eleven pence Curr.t money of maryland as by his Note here with In Court Produced may appear and so thereof being Indebted ye same Jacob in Consideration thereof afterwards to witt ye Day & year afd at ye County afd within ye Jur afd upon himselfe assumed & to ye Same John then and there faithfully promised that he ye Said Jacob ye afd Sum of two p.ds twelve Shill.s & eleven pence to ye afd John when afterwards he Should be thereunto requested he would well & faithfully Content & pay Nevertheless ye same Jacob his promiss & assumption afd in form afd made ^not^ reguarding & plotting & fraudulently Intending ye afd John In that part Craftilly & Subtilly to defraud & Deceive ye afd sum of two pounds twelve Shills & ten Eleven pence or any part thereof to ye afd John although afterwards to witt ye tenth day of September Seventeen hundred & twenty three at ye County afd within ye Jur: afd was thereunto requested hath not paid him for it in anywise Contented but ye same Jacob ye same hitherto to doe hath altogether refused & Still doth refuse whereby ye same John says he is worse & hath Damage to ye value of four pounds Curr.t mony & thereof he brings this suite ye L Gale P Quer pledges &c Jn.o Doe Richd Roe And the Said Jacob Messick by George Dashiell his attorney Cometh and defendeth the force and Injury when &c and Prays Leave to Imparle hereunto untill the Next Court and he hath it and the Same day is given to the afd Plft also Att which said next Court to witt the Sixteenth day of march ann.o Dom One thousand Seven hundred and twenty four Came againe as well the afd Jn.o Cumberbatch as the afd Jacob Mizick by their attorneys afd and thereupon the said Jacob Mezick by his Said attorney Prayed further Leave to Imparle hereunto untill the Next Court and he hath it and the Same day is given to the afd Plft also &c Att which said Next Court day of June to witt the this fifteenth day of June month ann.o Dom One thousand Seven hundred and twenty five Came againe as well the afd John Cumberbatch ^as the afd Jacob Mezick^ by their attorneys afd and thereupon the Said Jacob Messick by his ^said^ attorney prayed further Leave thereof of to Imparle hereunto ^untill the Next Court^ and he hath it and the Same day is give to the afd deft also Att which Said Next Court to witt the Eighteenth day of august anno Dom One thousand Seven hundred and twenty five Came againe as well the afd Jn.o Cumberbatch as the afd Jacob Messick by their attorneys afd and thereupon the Said Jacob Messick by his Said attorney as before defends the force and Injury when ye and prays Judgm.t if the plft his action afd against him to have ought because he saith y.t a Certain Rich.d Tiler at a Court held at Dividing Creek ye third tuesday of Novem: one thousand seven hundred & twenty two did attach ye sum of two pd.s twelve Shill & eleven pence in ye hands of ye said Mesick & had Condemnation as ye effects of Joshua Mesick which he prays may be in Barr to ye said action according to ye form of an act of Assembly of this province Now in force in such Case Made & Provided George Dashiell |
