                        March Court            1725                 118

John Bishop Shall pay the Condemnation of the Court thereupon or Render his body to the Custody of the Sherr of
Somersett County in Satisfaction thereof or that he ye said David Hutson will do it for him &c

              And the said John Bishop by Ebenezer Cook his attorney Cometh and defendeth the force and Injury
when &c and says that he Cannot gainsay the plft his action afd so as afd against him brought nor Can he say
but that the said plft Ought to recover his damages by Occasion of the premisses afd to five hundred and
thirty pounds of tob.o and Costs of Suite against him which the Said plft doth not gainsay &c

                Therefore it is Considered by the Justices here that the afd Joseph MaClester Recover against
the afd Jn.o Bishop as well the Sum of five hundred and thirty pounds of tobo his damages afd in form afd
302   Confessed as also the Sum of three hundred and two                                  pounds of tobo by the
Court here adjudged unto him for his Costs and charges by him about his Suite in this behalfe Laid out and
Expended and the afd deft in mercy &c

 Command was given to the Sherr of Somersett County that he Should take Thomas
Pryor Late of Somersett County Planter if he Should be found in his Bailywick &
and him Should Safe Keep so that he might have his body before the Justices of his
Lordships County Court to Somersett to be held at Dividing Creek the third tuesday of march then next
to answer unto William Ennalls of a plea of trespass upon the Case and that thereof he should not
fail &c                And whereupon the same W.m Ennalls by Levin Gale hs attry Complains that
the afd Tho.s Pryor the twenty Seventh day of Novem anno Dom one thousand Seven hundred
& twenty five at the County of Somersett afd within the Jur of this Court was Indebted
to the afd W.m in the Sum of twenty one pounds three Shill.s & five pence Currt mony for
divers Goods wears and Marchant Dizes at the Speciall Instance & request of the Said Tho.s
Sold & Delivered & so thereof being Indebted the said Tho.s afterwards to witt the same day &
year afd at the County afd within the afd Jur in Consideration thereof upon himselfe assumed
& to the same W.m then & there faithfully promised that he when afterwards he should
be thereto requested the afd Sum of twenty one pounds three Shill & five pence to the same
W.m he woud well & faithfully Content & pay Nevertheless the afd Tho.s his promis & assumption
altogether refused & Still doth refuse whereby the same W.m Says he is wors & hath
Dam to the value of forty two pounds four Shillings & ten pence Currt mony & thereof
he bringeth Suite &c                                           L Gale P Quer pledges &c  Jno Doe Rd Roe
