108 of a plea that he render unto him the full & Just Quantity of one thousand Nine hundred & fifty four pounds of tob.o which to him he ows & unjustly Detains &c And Whereupon the same Benj.a by Levin Gale his attry Saith that whereas the afd John Sumers the thirty first day of may Seventeen hundred & sixteen by his Certain writing obligatory granted himselfe to be held & firmly bound unto ye same Benj.a in the full and Just Quantity of one thousand nine hundred & fifty four pounds of tob.o to be paid the Same Benj.a when afterwards the said John should be thereto required yett the afd John thought often there to required the afd Sum of one thousand nine hundred & fifty four pounds of tob.o to the same Benjamin hath not rendered but same John the Same hither to to the same Benj.a to render hath altogether denyed & still doth deny whereby the same Benj.a says he is wors & hath dam to the value of three thousand pounds of tob.o thereof he brings this Suite &c and the same Benjamin brings hereinto Court the Writing Obligatory afd &c Levin Gale P Quer Pledgs &c Jno Do R Roe And the Said John Sumers in his Own proper person Cometh and defendeth the force & Injury when &c and says that he Cannot gainsay the Plft his action afd against him brought nor Can he Say but that the writing obligatory afd is his act and deed and that the debt therein mentioned is yett due and unsatisfyed wherefore the Said plft Prays Judgm.t for his debt afd and his Costs and Damages Sustained by Occasion of the detaining of the Same debt to him to be adjudged Therefore it is Considered by the Justices here the fifteenth day of march ann Dom One thousand Seven hundred and twenty five that the afd Benjamin Wailes Recover against the afd ^John Sumers^ Arthur Warwick as well the sum of one thousand Nine hundred and fifty four pounds of tobo his debt afd as also the Sum of Two hundred & 261 sixty one pounds of tobo for his Costs and damages sustained by occasion of the detaining of the same debt to the same Benja Wailes of his assent by the Court here adjudged and the afd deft in Mercy &c
And Whereupon the same Benj.a by Levin Gale his Attry Saith that whereas the afd Thomas the Eleventh day of aug.t Seventeen hundred & Nineteen at the County afd within the Jur of this Court by his Certain writing obligatory Granted himselfe to be held & firmly bound unto the same Benj.a in the afd Sum of One thousand five hundred sev^e^nty & eight pounds of Good (Sound) |
