W.m Whittington
 Command was given to the Sherr of Somersett County that he Should take W.m
Whittington Late of Somersett County Gent if he Should be found in his bailywick
and him Should Safe Keep so that he might have his body before the
    Justices of his Lordships County Court of Somersett to be held at Dividing Creek the
    third tuesday of March then next to answer unto Alex.d Hall of a plea of trespass
    upon the Case &c  And that thereof he should not fail &c

    And the said Alexander Hall by Levin Gale his attorney proceeded against the afd
    William Whittington in the plea afd as followeth vizt   William Whittington Late
    of Somersett County Gent.m was attached to answer unto Alex.d Hall of a plea of trepass
    upon the Case &c                            And Whereupon the same Alex.d by Levin
    Gale his Attorney Complains that whereas the said W.m the tenth day of June one
    thousand Seven hundred and twenty five at the County afd within the Jur of this Court was
    Indebted to the same Alexd in the sum of five hundred pounds of tob.o p y.r acc.t being ^hereinto^
    Court brought may appear  And so thereof being Indebted the Same W.m in Consideration
    thereof afterwards to witt the day and year afd at the County afd within ye Jur of this
    Court upon himselfe assumed and to the Said Alex.d Hall then & there faithfully
    Promised that he the said W.m Whittington when afterwards he should be thereunto
    Requested he the afd Sum of five hundred pounds of tob.o to the same Alex.d would well &
    faithfully Content & pay Nevertheless y.e s.d W.m Whittington his promis & assumption
    afd in form afd made Little regarding and Plotting & fraudulently Intending the same  
    Alex.d in that part to Defraud & Deceive the said Sum of five hundred pounds of tobo or
    any part thereof to the Same Allex.d hath not paid or him for it in any wise Contented
    altho' the same to doe the afd W.m was requested afterwards to wit the tenth day of July
    Ann Dom Seventeen hundred and twenty five at the County afd within the Jur afd but the
    afd William the same hitherto to pay or the same Alex.d for it in anywise to Content
    hath altogether refused and Still do the refuse whereby the same Alex.d says he is
    wors & hath Damage to the value of one thousand pounds of tob.o & thereof he bring this suite &c

    a Copy of the foregoing declaration was made and Sent to be Served on the deft with the writt
    in the plea afd      Att which Said third tuesday of march to witt the fifteenth day of the same
    month being the day of the Return of the Said Writt Cometh the Said ann Dom One thousand
    seven hundred and twenty five Cometh the Said Alexander Hall by his attorney afd and ye
    Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and
    maketh return thereof to the Court here Endorsed viz.t  Cepi Corpus P Fran: Allen Sher

             And the Said William Whittington in his proper person Cometh and defendeth the
    force and Injury when &c and says that he Cannot gain Say the plft his action afd so as
