5 Can he say but that the said Plft ought to Recover his damages by occation of the Premises afd to the sum of Eight hundred and twenty seven pounds of tobacco and Costs of Suite against him which the said Plft doth not gainsay Therefore it is Considered by the Justices here the Nineteenth day of March Anno Dom One thousand seven hundred and twenty two that the said Thomas Dashiel Recson against the said James Jones as well the sum of Eight hundred and twenty seven pounds of tobo Certain Damages afd in form afd Confesed Cost (29) as also the sum of Two hundred and forty Nine pounds of tobo by the Court adjudged unto him for his Cost and Charges by him about his Suite in this Behalfe Laid Out and Expended and ye deft in mercy &c
of a plea of trespass upon ye Case &.c and that thereof he should not fail &.c And whereupon the said Robert by Francis Allen his attorney Complains that whereas the Said James the thirtieth day of November Ann Dom One thousand Seven hundred and twenty two at ye Parish and County afd within the Jurisdiction of this Court was Indebted unto ye said Robert in Six hundred and forty pounds of tobacco for Levies Sheriffs Fees and Publick dues and forbearance thereupon to ye said Robert then and there due oweing and unpaid as by an acco.t thereof hereunto annexed may in Court appear and Being so thereof Indebted the said James in Consideration thereof afterwards to witt the day and year afd at ye Place afd upon himselfe did assume and to ye said Robert then and there faithfully did Promise that he the Said James the afd Six hundred and forty Pounds of tob.o to the said Robert when he should be afterwards thereunto required he would well and faithfully Pay and Content and altho' he the said James One hundred and thirty Pounds of tobacco Percell of ye afd six hundred and forty pounds of tobacco to ye said Robert he hath paid and satisfied yett as to five hundred and ten pounds of tobacco residue of ye afd six hundred and forty Pounds of tobacco the said James his Promise and assureing he is afd in form afd made little regarding but Plotting and fraudulently Intending the said Robert in that Cert Craftely and Subtely to deceive and defraud ye afd five hundred and ten pounds of tobo to the said Robert he hath not paid or to him for the same in any wise Contented alltho' the same to do the Said James by the said Rob.t on ye first day of December in the year afd and often afterwards at ye Parish and County afd within the Jurisdiction afd he was hereunto requested but ye same to him to pay or in anywise Content hath refused and still doth refuse and doing whereupon the said Robert saith he is worse and hath damage to the value of One thousand and twenty pounds of tobacco and thereupon he Brings Suite &.c Allen [illegible]
