March Cort - 1722 mentioned that the afd Sum of ten pounds Curr.t money so as afd acknowledged and Entered into by the said Margrett Holder be forfeited and become due to his Lordship the Lord Proprietary his heirs and successors to be Levied on her goods anc Chattles Lands and tenements as afd &.c
is to find and Provide for ye said Joe Magee sufficient meett Drink washing Lodgeing and apparell dureing the servitude afd meet for him y.e said Joe Magee to have and wear &c
Court was taken and arrested for Suspition of Felony by Joseph M.ccChester Sheriff of the County afd that ye afd Joseph Holder the day and year aforesaid with force and arms &.a at Stepney Parish afd in ye County afd in the Custody of the afd M.ccChester being for ye suspition of the felony afd arrested himself from ye Custody of the afd M.ccChester then and there feloniously rescued and Escaped against ye Peace &.a Test Joseph Dashiel W.m Tazewell R Lopp This Indictn.t was on Mocon of of W.m Tazewell Clerk of Indictments by the Court approved to be sent to ye grant Jury Alex.d Hall Cl On the Back of the foregoing Bill of Indictm.t it was thus Endorst Billa Vera James Rownd foreman Thereupon Command is given to the Sherr of Somrsett County that he take the said Joseph Holder if &.c to answer &.c in whos Custody Before was Committed. And Now hereafterwards to witt this nineteenth day of march Ann Dom One thousand seven hundred and twenty two Comes the said Joseph Holder in Custody of the Sherr afd and being by the ^said^ Sherr sett to the Bar is thereupon Instantly demanded how he would acquitt himselfe of the Premises afd saith that of the Premises afd he is noe wise guilty thereof and thereof for tryall putts himselfe upon the Country and Will.m Tazewell who for his said Lordship in this Part Prosecutes in Like manner Thereupon Command is given to the sherr of Somrsett County that Immediately he Cause to Come here twelve &.c by whom &.c who neither &.c to recognize &.c because as well &.c of which said Preceipt the said Sherr to witt Joseph M.ccChester Gent makes return that he has here ready twelve &.c as by his said Preceipt he was Commanded and the Jurors therein Impannelled being Called Came to witt Capwell King Henry Ballard John Pope Henry Sufeild Moses Fenton William Mills Henry Alexander Edward Rownd, Robert Hill Charles Townsend, James Hall Andrew Sampson who being duly Elected tryed and Sworn to say the truth in the Premises upon their Oath do say that the said Joseph Holder is guilty of the Premises as by the above Indictm.t is Imposed on him Wherefore it is Considered by the Justices here that the said Joseph Holder be fined to his Lordship the sum of five hundred pounds of tob.o and to be Imprisoned five days by Occation (of) |
