409   whole do amount to Eleven pounds ten shillings sterling as also the sum of Four hundred & Nine
(410)                                       pounds of tobacco by the Court here adjudged unto them for their Costs and
          Charges by them about their Suite in this Behalfe Laid Out and Expended and ye do to be Levied of
          the goods and Chattles which were of the said William Skirvin at the time of his death in the hands
          of the said Esther Skirvin Ex.rx as afd remaining to be administered if so much thereof in her hands she
          hath &.c and if so much therof in her hands she hath not &.c then the Costs afd to be Levied on the proper
          goods and CHattles of the said Esther Skirvin

 Sommersett County ss.t  Abraham Mason of Coventry Parish in the County of
Sommersett Planter was attached to answer Thomas Drummond and Mary his
wife admrx of all and singular the goods and Chattles Rights and Creditts
of John Griffith dec.d of a plea of trespass upon the Case &.c
                                        And whereupon the said Thomas and Mary by Francis Allen their attorney Compaine that
          whereas the said Abraham the twenty fourth day of march Ann Dom One thousand seven hundred and twenty
          at Sommersett County afd within the Jurisdiction of this Court was Indebted unto the said John in his LIfe time
          in two thousand three hundred Eighty five and a halfe pounds of tobacco ^as^ by an acco.t hereunto annexed may
          in Court appear and being so thereof Indebted the said Abraham afterwards to witt the afd twenty fourth
          day of march in the year afd at the Place afd within the Jurisdiction afd in Consideration thereof upon himselfe
          did assume and to the said John in his Life time then and there did faithfully Promise that he the said Abraham
          the said two thousand three hundred Eighty five and a halfe pounds of tobacco to the said John when he should be
          thereunto requested he would well and faithfully Pray and Content  And altho' the said Abraham fifty five
          pounds of tobo Pcell of the afd two thousand three hundred Eighty give and a halfe Pounds of tobacco to the said John
          in his Life time to be Paid and Satisfied yett as to the residue thereof being two thousand three hundred thirty and
          a halfe pounds of tobacco the said Abraham his Promise and assumption afd in form afd made Little regarding
          but Plotting and fraudulently Intending the said John in his Life time and the afd Mary whilst sole after the
          death of the said John and the afd Thomas and Mary after the Espousalls between them Celebrated in that
          Part Craftily and subtilly to deceive and defraud the said two thousand three hundred thirty and a halfe pounds
          of tobacco or any Part therof to the said John in his Life time or to the afd Mary whilst she was sole after
          the death of the said John or to the afd Thomas and Mary after the Espousalls Between the Celebrated hath
          not Paid or in any wise for the same Contented altho' the said same to do the said Abraham by the afd
          John in his Life time to witt on the afd twenty fourth day of march in the year afd and often afterwards
          at the Place afd within the afd Jurisdiction and by the afd Mary whilst she was sole after the death of
          the said John and by the said Thomas and Mary after the Espousalls between them Celebrated he was thereunto
          requested hath not Paid but the same to the said John in his Life time or to the said Mary after the death
          of the said John or to the afd Thomas and Mary after ^the^ Espousalls between them Celebrated hitherto to pay
          hath altogether refused and the same to the said Thomas and Mary to pay still doth refuse and deny
          whereupon they say they are worse and have damage to the value of four thousand pounds of tob.o
