(33) A Copy of the foregoing decl.n was made and Sent with the writt in the Plea aforesaid Att which said third tuesday of march to witt the Nineteenth day of the same month Ann Dom one thousand seven hundred and twenty two being the day of the return of the said Writt Comes the Wescott Gray by his attorney afd and the sherr of Sommrsett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these words following viz.t Cepy: Jos: MccChester Sherr thereupon the Court adjourns untill the third tuesday of Aprill Next being the thirtieth day of the same month Ann Dom One thousand seven hundred and twenty three on which day the Court being satt Comes againe the Wescott Gray by his attorney afd and prays that the said Isaac Atkinson to his declaration in the Plea afd may Answer And the afd Isaac Atkinson by Levin Gale his attorney Comes and defends the force and Injury when &c and says he is not guilty of the Premisses above upon him Imposed in manner and forme as the afd Wescott hath against him Complained and of this he puts himself upon the Country &c And the Plft in Like manner Alle P Qrte Thereupon Command is Given to the sherr of Sommersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c Of which said Preceipt the said sherr to witt Joseph M.ccChester Gent now hereat to witt the same day and year Last mentioned makes return that he has here ready twelve &c as by his Preceipt he was Commanded and Now hereafter to witt the same day and year Comes as well the said Plft as the said Deft by their attorneys afd and the Jurors of that Jury Impannelled who being Called Likewise Came to witt William Lane John Dennis Sen John Pope Henry Scofield Moses Fenton, William Mills Daniel Cowdery Neal M.ccChester Robert Hill Charles Townsend James Hall Ebenezer Handy who being duely Elected tryed and sworn to say the truth in the Premisses upon their Oath do say that the said Isaac Atkinson is guilty of the Premises above upon him Imposed in manner and form as the said Wescott Gray above against him hath Complained and doe assess the Damages of the said Wescott Gray to seven by Occasion of the Premisses afd to seven Pounds lawfull mony of america and one pound of tobo Costs besides his Costs and Charges by him about his suite in this Behalfe Laid Out and Expended Therefore it is Considered by the Justices here the thirtieth day of Aprill Ann Dom One thousand seven hundred and twenty three afd that the said Wescott Gray recover against the said Isaac Atkinson as well the sum of seven pounds Lawfull mony of america Com his damages by Occasion of the Premisses afd in form afd assesed as also the sum of thirteen hundred and Twenty (1325) six Pounds of tobo by the Court here adjudged unto him for his Costs and Charges by him about his suite in this Behalfe Laid Out and Expended and ye Deft in mercy &c
