Att which said next Court to witt the seventeenth day of march ann Dom one thousand seven hundred
and twenty three Come againe as well the said Plft as the said deft by their attorneys afd & the said
deft by his said attorney as before defends the force and Injury when &c and saith that he doth not gainsay
but that he was Indebted unto the said Robert the sum mentioned in the declaration afd but
further saith that the said Robert Never did demand the same according to the form of an act of assembly
of this province now in force in such Cases made and provided and this he is Ready to verifie and
therefore prays Judgm.t whether the said Robert his action afd against him to have Ought Dashiell P Deft
And the afd Robert saith that he the said Robert on the first day of December ann Dom One thousand
seven hundred & twenty and often afterwards at Stepney Parish in Somersett County afd within the
Jurisdiction of this Court did demand of the afd Richard Kellum the afd four hundred and sixty
pounds of tobacco as the said Robert above in his declaration hath alledged and this he prays may be
Enquired of by the Country &c   F Allen P Quer & the deft in Like manner Dashiel P Deft
       Whereupon the said Richard Kellum by his attorney ^afd^ Relinquisheth his verification afd by him above
pleaded and says that he Cannot gainsay the plft his action afd so as afd against him brought nor Can
he say but that the said plft Ought to Recover his damages by Occasion of the premisses afd to four hundred
and sixty pounds of tobo which the said plft does not gainsay &c
          Therefore it is Considered by the Justices here the seventeenth day of march ann Dom One thousand
       seven hundred and twenty three afd that the said Robert Martin Recover against the said Richard
       Kellum as well the sum of four hundred & sixty pounds of tobo his damages afd in form afd Confessed as
(347)   also the sum of Three hundred & forty seven                                       pounds of tobo by the Court
       here adjudged unto him for his Costs and Charges by him about his suite in this Behalfe Laid Out & Expended &
       ye deft in mercy &c  Whereupon the afd plft gratis here in Court Remitteth the afd Deft from the above
       Costs of Suite and that the same deft of the same Costs of Suite be quiett &c

 memorand.m the plft by his attorney Sued Out his Lordships writt ag.t the deft the

tenour whereof follows in these words vizt Somersett County fs: Charles absolute
Lord and proprietary of the provinces of maryland and avalon Lord Baron of
                               Baltemore &c   To the sherr of Somersett County Greeting We Command you that ^you attach^ of the goods ^and Chattells^
    of Anthony More of Coventry parish in the County of Somersett Planter if they they shall be found in your
    Bailywick to the value of twelve hundred pounds of tobacco and when you have the same so attached
    or any part thereof the same in your Custody Safe Keep so that you have the same Before the Justices
    of Our County Court to be held at dividing Creek in Somersett County afd the third tuesday of June next then
    and there to be Condemned according to act of assembly to and for the use of a Certain Robert Martin unless
    the said Anthony More by himselfe or his attorney shall appear and answer unto the said Rob.t
    Martin in a plea of trespass upon the Case &c according to Law and that by good and Lawfull men
    of your Bailywick you make Known unto the person or persons in whose hands you make
