1723 164 in Custody as afd as well seven Barr.lls of Indian Corn his damages by occasion of the premisses afd as also the sum of two hundred and Eighty three pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite in this behalfe Laid out & Expended & the deft in mercy &c And that the said deft Remain in Custody of the Sherr of Somersett County to be by him in the prison of the said County Safe Kept untill the plft of his damages & Costs afd shall be fully satisfied &c
Quillin according to the return of the writt in the plea afd thereupon the said Sherr prays further day untill next Court to Bring in the Body of the Said Thomas Quillin to answer &c which to him is granted Att which said Next Court to witt the seventeenth day of march ann Dom one thousand seven hundred and twenty three Comes the said sherr and Brings into Court the said Thomas Quillin to answer &c Whereupon the said Thomas Quillin at the prayer of the plfts attorney is adjudged to give Speciall Bail to the act afd but for want thereof the said Thomas Quillin is Committed into the Custody of the sherr of Somersett County there to remain &c the said sherr being Present here in Court took Charge of the said Thomas Quillin accordingly &c and afterwards in the same Court the Justices of the County afd returns a Certain Bail Peice by them taken according to an act of assembly in this province now in force which follows in these words viz.t Thomas Dashiell plft ag.t Thomas Quillin deft you Jonathan Jackson do undertake for the said Thomas Quillin deft in the sum of ten pounds Curr.t money to be Levied on your goods and Chattells Lands and tenements to the use of the said Thomas Dashiell plft upon Condition that if the said Thomas Dashiell do obtain Judgmt in a Certain action of trespass upon the Case depending in Somersett County Court against the said Thomas Quillin deft that than the said Thomas Quillin shall pay the Condemnation of the Court thereupon or deliver himselfe to the Custody of the sherr of the said Coty in satisfaction thereof or you Jonathan Jackson will do it for him you acknowledge your selfe to be Content therewith this taken the 4.th day of aprill ann 1724 before us James Dashiell Jno Handy
and County afd within the Jurisdiction of this Court was Indebted unto the said Robert in four hundred & sixty pounds of tobacco for Levies and forbearance thereupon to the said Robert then and there due owing and unpaid as by an acco.t thereof hereunto annexed may in Court appear and being so thereof Indebted the said John in Consideration thereof afterwards to witt the day and year afd at the place afd upon himselfe did assume and to the said Robert then and there did faithfully promise that he the said John the afd four hundred and sixty p.ds (of) |
