1723 131 Att which said third tuesday of June to witt the Eighteenth day of the same month ann dom one thousand seven hundred and twenty three Being the day of the return of the said Writt Cometh the said Charles Ratcliff Ex.r as afd by his attorney afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the court here Endorst in these words following vizt By Vertue of the within Writt to me directed to the Justices within Mentioned I Certifie that I have attached in the hands of William Walton thirty pounds as the rights and Creditts of the said Will.m Martindale I further Certifie that I have Given Notice to the said William Walton that he be & appear at the time & place within Contained to shew Cau &c before John Doe & richard Roe good & Lawfull men of my Bailywick as by the within writt I am Commanded so answer Jos: MccClester Sherr And the said William Walton ^garnishee as afd^ by in his own proper person Comes and defends the force & Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it & the same day is Given tot he plft also Att which said next Court to witt the twentieth day of august ann Dom One thousand seven hundred and twenty three Comes againe as well the said Charles Ratcliffe Ex.r as afd by the said attorney afd as the said William Walton in his proper person and thereupon the said Walton puts in his Stead Levin Gale attorney at Law to act in the premisses afd and prays further Leave to Imparle hereunto untill the next Court and he hat it & the same day is Given to the plft also Att which said next Court to witt the Ninteenth day of November ann Dom One thousand seven hundred and twenty three Comes again as well the said Charles Ratcliffe Ex.r as afd by his attorney afd as the said William Walton in his Own proper person and thereupon the said William Walton says that he Cannot Gainsay but that he hath of the rights and Creditts of the said William Martindale that is to say one pewter quart Pott One Note on Richard Hudson of the value of the value of five pounds and Nine pence and a small List of Debts nor but that the same ought to be Condemned for the use of the said Charles Ratcliffe Ex.r as afd as the rights & Creditts of the said William Martindale which the said plft does not gainsay Whereupon the said Charles Ratcliff Exr as afd by his attorney afd prays that the Pewter quart pott Note & small List of Debts afd so as afd Confessed by the afd William Waltom as the Rights and Creditts of the said William Martindale may be Condemned towards satisfieing unto the said Charles Ratcliffe the afd sum of thirty pounds afd &c Therefore it is Considered by the Justices here the Ninteenth day of November ann Dom One thousand seven hundred and twenty three afd that the afd Pewter Quart Pott note of the value of five pounds and Nine pence and small List of Debts so as afd Confesed be Condemned ^in the hands of the said William Waltom^ as of the rights and Creditts of the said William Martindale for the Use of the said Charles Ratcliff Ex.r (207) as afd as also the sume of Two hundred & seven pounds of tobacco by ye Court here adjudged for his Costs and Charges in this Behalfe Laid Out & Expended &c mem.d ye garnishee W.m Walton voluntary takes his Oath that he hath noe more of ye Effects of ye Defts in his hands than what he has Confessed |
