 Somersett County fs.t  Peter Colloway of Stepney parish in Somersett County planter was attached to

answer unto Robert Martin of a plea of trespass upon the Case &c
                                              And whereupon the said Robert by Francis Allen his attorney Complaines that whereas
       the said Peter the thirtieth day of November ann Dom one thousand seven hundred and twenty two at the parish
       and County afd within the Jurisdiction of this Court was Indebted unto the said Robert in one thousand two
       hundred fifty and two pounds of tobacco for Levies and publick dues and forbearance thereupon to the said Robert
       then and there due owing and unpaid as by an acco.t thereof hereunto annexed may in Court appear and being
       so thereof Indebted the Said Peter in Consideration thereof upon himselfe did assume and to the said Robert then
       and there did faithfully promise that the said Peter the afd one thousand two hundred and fifty two pounds of
       tobacco to the said Robert when he should afterwards thereunto requested he would well and faithfully pay & Content
       altho' the said Peter one hundred and sixteen pounds of tobacco percell of the afd one thousand two hundred
       and fifty two pounds of tobacco to the said Robert he hath paid and satisfied yett as to Eleven hundred thirty & six
       pounds of tobacco residue of the afd one thousand and two hundred and fifty two pounds of tobacco the said Peter
       his promise and assumption afd in form afd made Little regarding but plotting & fraudulently Intending the said
       Robert in that Part Craftily and Subtilly to deceive and defraud the afd Eleven hundred and thirty six pounds
       of tobacco to the said Robert he hath not paid or to him for the same in any sort Contented altho' the same to doe the
       same Peter by the said Robert on the first day of December in the year afd and often afterwards at the County and
       parish afd within the Jurisdiction of this he was thereunto requested but the same to him to pay or in any wise to Content
       hath refused and still doth refuse and deny whereupon the said Robert saith he is worse and hath damage
       to the value of two thousand two hundred and seventy two pounds of tobacco & thereupon he Beings Suite &c

    also                  Att which said next Court to witt the Eighteenth day of June Ann Dom One thousand seven hundred
    and twenty three Comes again as well the said Robert Martin as the said Peter Colloway by their attorneys afd
    and the said Peter by his said attorney prays further Leave to Imparle hereunto untill the next Court & he hat
    it and the same day is Given to the plft also
                         Att which said next Court to witt the twentieth day of August ann Dom One thousand seven hundred
    and twenty three Comes again as well the said Robert Martin as the said Peter Colloway by their attorneys afd
    and the said Peter by his said attorney prays further Leave to Imparle hereunto ^untill ye next Court^ and he hath it and the
    same day is Given to the plft also                  Att which said next Court C to witt the Ninteenth day of November
