(128) appear before the Justices of his Lordships County Court to be held at Dividing Creek for the County of Somersett the third tuesday of November next to Shew Cause in form afd &c if &c and further &c the same day is given to the said Benjamin Wailes also Att which said third tuesday of November to witt Ninteenth day of the same month ann Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Cometh the said Benjamin Wailes by his attorney afd and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorst in these words Endorst vizt Nihill P Jos: MccClester Sherr Whereupon the said William Pepper altho' Solemnly Called Comes not nor shews Cause why &c but makes default whereby the said plft Remains against the said deft thereof wholy undefended Therefore it is Considered by the Justices here the Ninteenth day of November ann Dom One thousand seven hundred and twenty three afd that the said Benjamin Wailes have Execution against the said William Pepper of the Judgm.t afd as well for the sum of thirty pounds two shillings and four pence a Certain Debt as also the sume of three hundred and twenty three pounds of tobo Costs of Suite as also the sum of One hundred and Ninty pounds of tobacco additional Costs of Suite as also the Su in the Judgm.t (394) afd specified as also the sum of Three hundred & Ninty four pounds of tobacco by the Court here adjudged unto him for his Costs and Damages sustained ^by occasion^ of Delay of Execution of the Judgmt afd &c
bail to the action afd Thereupon a Certain Colebourn Taylor of Somersett County Planter present here in Court undertakes for the said John Taylor ^John Taylor the in Case the said^ Thomas Dashiell shall recover Judgmt in the plea afd against the said John Taylor or that the said John Taylor shall be therein Convict that then he the said John Taylor shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the Sherr of Somersett County in Satisfaction thereof or that he the said Colebourn Taylor will do it for him thereupon the said John Taylor in his own proper person appears & Imparles till next Court &c
