109 Somersett County in the province of maryland Gentl attorney in fact to the right honourable Margarett Lady Baltemore Widdow and Exrx of the Last will and testament of the Right honourable Charles absolute Lord and proprietary of the provinces of maryland and avalon Lord Baron of Baltemore &.c Lately decd am held and firmly Bound unto Thomas Layfield of the said County Gentl in the full and Just Sum of One thousand four hundred and Ninty six pounds of good sound merchantable Leafe tobacco and ^in^ Cask to Contain the Same to be paid unto the said Thomas Layfeild his heirs Exrs admrs or assignes to which payment well and truely to be made I bind my selfe my heirs Exrs and admrs firmly by these presents sealed with my Seall dated the 20.th day of august Ann Dom 1723 The Condition of the above Obligation is such that Whereas the said John Caldwell as attorney in fact for the said Right honourable Margarett Lady Baltemore hath appealed from A Judgm.t upon the verdict of a Jury found against her the said Lady Baltemore on the Behalfe of the said Thomas Layfield this present twentieth day of august at the County Court of his Lordships held for Somersett County afd at dividing Creek if therefore the said John Caldwell on Behalfe of the said Margarett Lady Baltemore shall pursue the direction of the act for regulating Writts of Error and Granting appeales at the next Provinciall Court to be held at Annapolis for the province of Maryland the second tuesday in September next and prosecute the same appeall with Effect and also satisfie and pay the said Thomas Layfield his Exrx admrs or assignes in Case the said Judgm.t shall be affirmed as well such Costs as shall be adjudged by the County Court afd as also al Cost and damages that shall be awarded by the Provinciall Court before whom the same appeall shall be heard tryed and determined as afd then the above Obligation to be void and of None Effect or Else to be and remain in full force power and vertue John Caldwell (seal) Sealed & Delivered in Prsence of us Jno Elzey Hugh Porter
twenty at Sommersett County and within the Jurisdiction of this Court was Indebted unto the afd John Rider in the sum of two pounds seven shillings and three pence Lawfull money of maryland for divers good wares and merchantdizes by the same John Rider unto the afd John Layton before that time there at the Speciall Instance and request of the same John Layton before that time there sold and delivered as by an acco.t thereof here in Court here in Court ready to be produced may appear and so thereof being Indebted the afd John Layton afterwards to witt the same Ninth day of may in the year afd at the County afd and (w.thin) |
