Stevens of the said County decd and residuary Legatees of all the Estate reall and personall of the said Coll William Stevens dec.d to answer unto Margarett Lady Baltemore Widdow and Executrix of the Last will and testament of the right honourable Charles Lord Baron of Baltemore dec.d of a plea that he render unto her three thousand pounds of good sound merchantable tobacco and Cask which from her he unjustly detains &.c And whereupon the said Margarett Lady Baltemore by Francis Allen her attorney Complaines that whereas the said William in his Life time to witt on the twenty third day of November ann Dom One thousand six hundred and Eighty six at the parish and County and within the Jurisdiction of this Court by his Certain Bill Obligatory Which the said Margarett Lady Baltemore With the Seall of the Said William in his Lifetime signed here into Court Brings the date whereof is the same day and year did acknowledge himselfe to be bound unto the said right honourable Charles Lord Baltemore in his Life time in the afd three thousand pounds of tobacco to be paid unto the the said right honourable Lord Baltimore his heirs or assignes at or upon the tenth day of October next Ensueing the day of the date of the said Bill yett the said William in his Lifetime nor the afd Elizabeth George Samuel and Thomas after the death of the said William the same unto the said right honourable Charles Lord Baltemore in his Lifetime or to the afd Margarett in her said Capacity after ye decase of the said Charles Lord Baltemore have not rendered but the same to render have denied and ye said Thomas the same to the said Margarett Lady Baltemore to render still doth deny and unjustly detaine to the retarding her in the Execution of the Last will and testament afd and thereupon bringes suite and Brings into Court here her Letters testamentary by which &.c Allen P Qrte Pledgs deft Jno Doe R Roe And the said Thomas Layfield son and heir as afd by Levin Gale his attorney Comes and defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is Given to the plft also Att which said next Court to witt the Ninteenth day of march ann Dom One thousand seven hundred and twenty two Comes againe as well ye said plft by her attorney afd as the said deft by his attorney afd and the said defend.t by his attorney prays further Leave to Imparle here unto untill the next Court and (he) |
