in the Sheriff of Said County to whome the writt in
   Said action was directed makes Return to the Court here on the Third Teusday
   in August vizt the Sixteenth day of Sd montyh anno Domi 1720 being the day of
   Return of Said writt Endorst Cepi Corpus pr Gideon Pearce Sheriff.
        Kent County in Maryland Sst. Daniell Whaley of Kent County Planter
   als Dics Daniel Whaley of Kent County in the province of Maryland planter was
   attached to answer unto Gilbert Falconer of a plea that he render him the Sume of
   [thr]ee thousand four hundred pounds of good Sound merchantable tobacco Clear
   [of a]ll trash and ground Leaves in Cask to Contain the Same of the value of thirty
   four pounds Sterling money which he unjustly Delayes &c. And whereupon
   the afd. pltf by Thomas Bowne his Attorney Saith that whereas the afd. Deft the ~
   Twelth day of august in the year of our Lord Christ one thousand Seven hun=
   dred and Eighteen at St. Pauls parish in Kent County within the Jurisdiction
   of this Court by his Certain Bill Obligatory which he the said Deft. Sealed with
   his Seal and as his Deed Delivered hereinto Court brought the date whereof
   is the Same day and year afd. bound and oblidged himself in the afd. Summ of
   three thousand and four hundred pounds of good Sound merchantable Tobacco
   Clear of all trash and ground Leaves of the afd value of thirty four pounds Sterling
   money afd. for the true payment of of the full and Just Summ of Seventeen hun=
   dred pounds of good sound merchantable Tobacco Clear of all Trash and ground
   Leaves with Cask to Contain the Same to the Said pltf. Convenient in the Said County
   at or upon the tenth day of November next Ensueing the date of the Said Bill Ob=
   =ligatory and the afd. pltf indeed Saith that the afd Pltf the afd. Sum of Seventeen hun=
   :dred pounds of Tobacco at or upon the afd tenth [day] of November to the afd. plt,sf
   hath not paid which he ought to have Done according to the form and Effect of
   the said Bill by which action hath acrued to the said pltf to Exact and have of the
   Afd Deft. the afd. Deft. the afd. Summ of three thousand four hundred pounds
   of Tobacco qualified as abovesaid Yet the afd Deft altho often required the
   afd Sum of three thousand four hundred pounds of merchantable Tobacco to the afd.
   pltf hath not paid But that to him to render or pay he the Said Deft. hitherto hath
   deneyed and Still doth Deney and Unjustly Detaines to the Damage of the Said
   pltf five pounds of like money afd. and thereupon he brings Suit &c.         Jno. Doe

      Whereupon at the prayer of the Pltf by his attry afd. the Deft. is adjudged to Give
   Special Bail to the action afd. and that the Sheriff of Said County keep the Said Deft
   in Safe Custody untill he Shall give Bail as afd.
