^DM Gilbert Higginson	\|	This being an Action of Trespass on the Case
^{and Company} —	\|	Commenced by the S^d. plt against the S^d Def^t.
a^t	\|	and wherein the Sheriff of Said County to whom
Robert Maxfield	\|	the writt in the S^d Action was directed makes
		Return to the Court on the third Teusday in

   June viz^t. the 21^st. day of the S^d. Month anno Domⁱ 1720 being the day
   of return of S^d Writt Endorst Cepi Corpus p^r Simon Wilmer Sher^f
        Kent County in Maryland Ss^t. Robert Maxfield late of Kent County Miller
   was Attached to answer unto Gilbert Higginson & Company Merchants in
   London of a plea of Trespass on the Case.    And whereupon the af^d plts by
   David Macbride their Attorney Complain that whereas the af^d Def^t. viz^t.
   the twentieth day of Aprill in the year of our Lord Christ one thousand
   Seven hundred and Seventeen at S^t pauls parish in Kent County within
   the Jurisdiction of this Court was Indebted to the Same plts in the Summ
   of twenty Six pounds of Merchantable Tobacco for diverse Goods wares &
   Merchandizes by the af^d. plts to the af^d. Def^t. at the Special Instance and
   request of the S^d Def^t. before that time Sold and delivered and So thereof being
   Indebted the af^d. Def^t. afterwards viz^t. the twentieth day of aprill in the year
   af^d. at the parish County and Jurisdiction af^d. in Consideration thereof upon
   himself Assumed ad to the S^d. plt^s. then and there faithfully promised that he
   the S^d Def^t. the af^d. Summ of twenty Six pounds of merchantable Tobacco to the S^d.
   plt^s. when thereunto afterwards he Should be required would well and truely
   pay and Content. And whereas also the af^d. Def^t. afterwards viz^t. the af^d.
   twentieth day of Aprile in the year af^d. at the parish County and Jurisdiction af^d
   and the af^d. plt^s. had Accounted together between themselves of and Concerning
   diverse Summs of Tobacco by the S^d Def^t. to the S^d. plt^s. before that time due and
   unpaid and upon that Accounting the Said Def^t. was found in Arrearage to the
   S^d. plt^s in the Sum of twenty Six pounds of Merchantable Tobacco in an account
   hereunto annexed Sett forth And So in arrearage being found the af^d. Def^t. in Con:
   Sideration thereof afterwards viz^t. the af^d. twentieth day of aprile in the year af^d.
   at the parish County and Jurisdiction af^d. upon himself assumed and to the
   Same plt^s. then and there faithfully promised that he the S^d. Def^t. the af^d. Summ of
   twenty Six pounds of Merchantable Tobacco to the S^d plt^s. when thereunto afterwards
   he Should be required would well and truely pay and Content.    And whereas –
   also the af^d. Def^t. afterwards viz^t the twentieth day of January in the year of our
   Lord Chirst one thousand Seven hundred and Seventeen at the Parish and County
   and within the Jurisdiction af^d. was indebted to the af^d. plt^s. in the Sum of one thous
   and two hundred and twenty pounds of merchantable Tobacco for diverse Goods
   wares and merchandizes at the Special Instance and request of the af^d Def^t. and
