   the Same hitherto hath denyed & Still doth deny to the damage of him the Said Plt~ Two.
   Thousand pounds of Tobacco and thereupon he brings Sute &ca.

   And the Said Deft~ being called came And the Said Plt~ by his attry afd prays that the Sd.
   Deft~ may give Special baile to the afd Accõn which is granted . . After which
   Thomas Jones of Said County comes hereinto Court and acknowledges himselfe as —
   Special baile in the afd Accõn and doth undertake for the afd Deft~ the payment
   of the Damages & Cost if it Should happen that the Said Plt. Shall obtaine Judgment~
   agst. the Said Deft~ in the afd Accõn And the Deft the Condemnation afd Shall not~.
   Satisfie nor himselfe to the Custody of the Sherf of Said County deliver or that the afd
   Thomas Jones the body of the Said Deft. Shall not render &ca.
    After which the afd Deft in his proper person appears to the afd Accõn and Saith that~
   he Cannot gainsay the Accõn afd of him the Said Plt~ nor but that he is indebted to the afd
   Plt. the Same of Twelve hundred Eighty four pounds of Tobacco and is willing that Judgmt.
   Should be Entered for the Same & Cost thereon Accrueing Therefore it is Considered by
   the Court here vizt. this Twenty first day of March Anno Domini One Thousand -
   Seven hundred and Seventeen That the Said Plt~. John Underling Senr. Recover
   against~ the Said Deft~. John Underling Junr. as well the afd Sume of Twelve—
   hundred Eighty four pounds of Tobacco Damages as also the Sume of Two hundred
   Seventy Seven pounds of Tobacco Cost by the afd Plt about his Sute in this behalfe —
   Expended and by the Court here of his assent adjudged and the Said Deft~. in mercy

   William Forbush | of a plea of Trespass on the Case and Whereupon the


Said Plt. by John Johnson his attorney complains .
   for that whereas the afd Deft~. the Twenty Sixth day of Mary one Thousand —
   Seven hundred & Sixteen at the Parish of St Peters in the County afd & within the
   Jurisdiciõn of this Court was indebted unto the Said Plt~ in the Sume of Three pounds
   & two pence Currant money of this Province for divers goods wares & Merchandizes
   by him the Said Plt~ to the Said Deft~ Sold & delivered and being So indebted —
   the Said Deft~ the day & Year afd in Consideration thereof did upon himselfe
   assume & to the Said Plt~. faithfully promise that he the Said Deft~ the Said Sum—
   of three pounds & two pence to the Said Plt~. when he Should be thereunto required
   would well & truly pay & Content Yet Nevertheless the afd Deft~ his promise
   and assumption afd in forme afd made little minding or regarding but plotting
   & fraudulently intending the Said Plt~ in this behalf craftilly & Subtilly to —
   deceive & defraud the Said three pounds & two pence to the Said Plt~ hath not~
   paid altho? to do the Same the Said Plt~. by the Said Deft~ the day & year afd
