   and Sixteen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court~.
   was Indebted unto the afd Plt~ in the Sume of Seven hundred and three pounds of
   Merchantable Tobacco for the like Sume of Tobo of the afd Plt~ by the afd Deft~.
   and to the use and behoofe of Said Deft~. before that time had and recd.
   and so thereof being Indebted the afd Deft~. In Consideration thereof afterwds
   vizt. the afd Third day of Janry. in the Year afd at the Parish County and Juris:
  :diciõn afd upon himselfe Assumed and to the Said Plt~ then and there last
   mentioend faithfully promised that he the Said Deft~. the afd Sume of Seven
   hundred and three pounds of Merchantable Tobacco unto the Said Plt. when
   thereunto required would well and truly pay and Content And that Whereas .
   also the afd Deft~ afterwards vizt. the afd third day of Janry in the Year afd -
   at the parish County and Jurisdicion afd had Accounted with the afd Plt~.
   of an concerning divers Summs of Tobacco by the afd Deft~ to the afd Plt before
   that time oweing and unpaid and upon that Accounting he the Said Deft~.
   then and there last mentioned was found in Arrearage towards the afd Plt in the
   Sume of Seven hundred and three pounds of Merchantable Tobacco and So thereof
   being found in Arrearage the afd Deft In Consideration thereof afterwards vizt
   the afd third day of Janry in the Year afd at the Parish County and Jurisdiciõn
   afd upon himself assumed and to the Said Plt then and there last mentioned
   faithfully promised that he the Said Deft~. the afd Sume of Seven hundred —
   and three pounds of Merchantable Tobacco to the Said Plt~. when thereunto ——
   required would well and Truly pay and Content Nevertheless the afd Deft~ his
   Severall promises and assumptions afd in form afd made litle regarding but~.
   plotting and fraudulently Intending him the Said Plt~. in that behalfe craftily
   and Subtilly to deceive and defraud the afd Severall Sumes of Tobacco in the
   whole amounting unto the Sume of fourteen hundred and Six pounds of Tobo
   to the Said Plt. altho’ afterwards vizt. the fourth day of Janry in the Year of our
   Lord Christ one Thousand Seven hundred and Sixteen and often after at the
   Parish County & Jurisdiciõn afd he the Said Deft~ by the Said Plt was thereunto required
   hath not paid nor made Content for the Same but that to him to pay or Content he the Said Deft hitherto
   hath denied and Still doth deny to the damage of him the Said Plt Two Thousand pounds of Merchantable Tobo.
   & thereupon he brings Sute &ca.
