   the Said Plt. his Execrs. Admrs. or Assigns Convenient in the afd County in and
   upon the tenth day of October next Ensuing the date of the Said Bill without
   fraud or further delay and the afd Plt. in deed Saith that the afd Deft hath
   not paid the afd Plt the afd Sume of Six hundred and fifty pounds of Tobo.
   at or upon the afd tenth day of October which he Should have paid to
   the afd Plt at or upon the afd tenth day of 8ber. according to the forme and
   Effect of the Said Bill by which Action hath accrewed to the Said Plt
   to Exact & have of the afd Deft the afd Sume of Thirteen hundred
   pounds of Tobacco Yett the afd Deft altho’ often required the afd Sume
   of thirteen hundred pounds of Tobacco to the Said Plt hath not paid —
   but that to him to render or pay hitherto hath deniedd and Still doth
   denie & unjustly detaine to the Damage of him the Said Plt twenty
   Six pounds of Sterling money and thereupon he brings Sute &ca
                                                   Bowne pr Querr Plds John Doe Richard Roe
    and now at this Court to wit the 19th day of August Anno Domi 1719
   here present the afd Deft in his proper person comes and defends the force
   and injury when &ca. And Says that he Cannot gainsay the Plt. his Accõn
   afd So as afd against him brought nor Can he Say but that the Said Plt
   ought to Recover his damages by Occation of the Premises afd to the Sume
   afd and Cost of Sute against him which the Said Plt does not gainsay —
   Therefore it is Considered by the Justices here the 19th day of August
   Anno Domi 1719 afd That the afd Philip Kennard recover against the
   Said John Ashley as well the Sume of Thirteen hundred pounds of Tobacc[o]
   his debt afd in forme afd Confessed as also the Sume of two hundred thirty
   Nine pounds of Tobacco by the Court here adjudged to him for his Costs and
   Charges by him abt. his Suite in this behalf laid out & expended and
   the Said Deft in mercy &ca. ——

   Thomas Windall Junr | whom the writ in the Same Accõn was directed makes

   Kent County | Ss  Thomas Windall Junr. late of Kent County Planter Stands Attached to
   Maryland |       Answer unto James Cruckshanks of a plea of Trespass on the Case

      And Whereupon the afd Plt by David Macbride his attry —
   Complains that whereas the afd Deft the tenth day of June in the Year of our Lord
   Christ one Thousand Seven hundred and nineteen at St. Pauls Parish in Kent
