March Court 1717 alis Dics Thomas Theakstone of Kent County in ye Province abovesaid Planter if he Should be found in his Bailywick and him safe keep So - that he have his body before his Said Lord Ships Justices of the Said Court to be held at our Court house in the Town of Chester in Said County to Answr. unto William Sweatnam & John Whittington of a plea that he render to . them ye Just Sum and neat quantity of fifteen Thousand Eight hundred and fourteen pounds of good Sound Merchantable well qualified bright Tobo and Cask Clean from all Manner of Trash of ye price & value of Eighty pounds . Sterling money which he unjustly detains &ca. And that he have then and there the Said writ &ca Att which Said next Court vizt. the nineteenth day of November the Same Year last mentioned the day of return of Said writ came Simon Wilmer Gent. high Sherf of Said County and made return thereof in these words Thereon Endorsed as - folls vizt. Cepi Corpus pr Simon Wilmer Sherf. And A Decln being fild - when Said writ Issued forth & A Copy thereof Served therewith According to Act of Assembly in Such Case made was as folls vizt. And Whereupon the afd William & John by Thomas Bowne their attry Say that Whereas the afd Thomas Theakstone ye nineth day of July in the Year of our Lord Christ Seventeen hundred and thirteen at St. Pauls Parish in Kent County afd in ye Jurisdiciõn of this Court by his certain Bill obligatory which he the Said Thomas Theakstone Sealed with his Seale and as his deed delivered hereinto Court brought the date whereof is ye Same day & Year afd bound himselfe to pay or cause to be paid to the afd William Sweatnam & John Whittington or to either of them by ye name of William Sweatnam & John Whittington of Queen Anns County Admr. of Edward Bathurst the afd Just Sum and neat quantity of fifteen Thousand Eight hundred and fourteen pounds fo good Sound Merchantable well qualified bright Tobacco and Caske Clean from all manner of trash of the afd price and value of Eighty pounds Sterling money Convenient in ye Kent County afd when thereunto required Yet the afd Thomas Theakstone altho’. often required the afd fifteen Thousand Eight hundred & fourteen pounds of Tobacco to the afd William and John or to either of them hitherto hath not paid but that to them and every of them to render or pay the Said Thomas Theakstone hitherto hath denied and Yet doth deny & unjustly detain to ye damage of ye Said Plt. ninety pounds Sterling money & thereupon they bring Sute &ca.
