   Summs of Tobacco which in the whole amounts unto the Summ of Two Thousand
   one hundred and Six pounds of Merchantable Tobacco he hath not minded nor
   in any wise kept but altho’ he the Said Deft~ hath paid and Satisfied to him—
   the Said Plt~. to the value of Six hundred pounds of Tobacco of the afd Summ—
   [of] two Thousand one hundred and Six pounds of Tobacco part Yet the afd Deft~.
   [his] promises & assumptions as to the Summ of ffifteen hundred and Six pounds of~
   [T]obacco of the afd two Thousand one hundred & Six pounds of Tobacco residue —
   little regarding but plotting and fraudulently Intending him the Said Plt~. of the
   afd Summ of fifteen hundred and Six pounds of Tobacco Craftily to deceive and —
   defraud the Said Summ of fifteen hundred and Six pounds of Tobacco the Same —
   Deft~ to him the Said Plt~. hath not paid nor made Content~ for the Same altho’ to pay the
   Same he the Said Deft. afterwds. vizt the Twenty Second day of November in ye Year of our
   Lord Christ one Thousand Seven hundred & Seventeen at the Parish County & Jurisdiciõn afd was —
   thereunto required but he the Same Deft~ the afd Summ of fifteen hundred & Six pounds of Tobacco
   to the Said Plt~. to pay or Content for the Same hitherto hath denyed and Still doth deney to the
   damages of him the Sd Plt. three Thousand pds of like Tobo. afd & thereupon brings Sute &ca

   And the Said Deft~. being called came And the Said Plt. by his afd attry prays
   that the Said Deft may give Special baile to the afd Accõn which is granted and —
   that he be kept in Safe Custody by the Sherf. of Said County untill he Shall give Special
   as afd .    .
      And the Said Deft~ Saith that he cannot gainsay the accon afd of him the Said
   Plt~. nor but that he is indebted to the afd Plt~ on ballance the Sume of ffour—
   hundred and fifty three pounds of Tobacco and is willing that Judgment~ Should be
   entered for the Same and Cost thereon accruing :    Therefore it is Considered by the
   Court here vizt. this Twentieth day of March Annoqe Domini One Thousand Seven—
   hundred and Seventeen That~. the afd Plt~. James Harris do recover against the
   Said Deft~ Francis Scott as well the afd Sume of ffour hundred and fifty three pounds
   of Tobacco Damages as also the Summe of Three hundred and Seventy five pounds
   of Tobacco Cost by the afd Plt~. about his Sute in this behalfe expended and by the Court~.
   here of his assent adjudged and the Said Deft~. in mercy &ca ——
