   truly Content and pay Nevertheless the afd Deft~ his promises & assumptions -
   afd in forme afd made litle minding or regarding but plotting & fraudulently
   intending him the Said Plt~ in this behalfe craftily & Subtilly to deceive & defraud
   the Said five hundred pounds of Tobacco to the Sd Plt~ altho’ often required the Sd
   Deft~ the thirteenth day of Febry in the Year afd at the Parish County and —
   Jurisdiciõn afd & oftner Since by the Said Plt~ hath been thereto required hath
   not paid nor to him for the Same hath not any wise contented but to him hitherto to pay
   hath hitherto refused & Still doth refuse wherefore he Says he is worse and hath damage to
   ye value of one Thousand pounds of Tobacco & thereupon he brings Sute &ca.

   And the Said Deft being called came And the Said Plt by his afd attry prayd
   that the Said Deft~ might give Special baile to the afd Accõn which is granted
   and that he be kept in Safe Custody by the Sherf of Said County untill he Shall
   give Special baile as afd And the Said Deft~ Saith that he Cannot gainsay
   the Accõn afd of him the Said Plt. nor but that he did promise to pay the
   Said Sume of five hundred pounds of Tobacco and is willing that Judgmt.
   Should be entered for the Same and Cost thereon accruing : Therefore it is -
   Considered by the Court here vizt. this Twentieth day of March Anno Domini
   One Thousand Seven hundred and Seventeen That the afd Plt. Francis
   Collins Recover against the Said Deft~ Francis Scott as well the afd Sume
   of five hundred pounds of Tobacco Damages on Account of the Said Plt~ not
   performing his promise and assumption afd and also the Sume of Three
   hundred fifty Seven pounds of Tobacco Cost by the afd Plt~ about his Sute in
   this behalfe Expended and by the Court here of his assent adjudged and the
   Said Deft~ in mercy

   John Moll — | Commanded it was to the Sherf. of Kent County the
           at | Twenty third day of November in the Second Year of his
   William Powell | Lordships Dominion &ca. That he take William Powell~

late of Kent County Planter if he Should be found in his -
   Ships Justices of the next Court to be held at our Court house in the Town of Chester
   in Said County to Answer unto John Moll of a plea of Trespass on the Case and —
   that he have then and there the Said writ &ca.    Att which Said next Court vizt
   the Eighteenth day of March the Same Year last mentioned the day of return
   of Said writ came Simon Wilmer Gent~. high Sherf. of Said County and made—
   return thereof in these words thereon endorsed as folls viz Cepi Corpus pr Simon
   Wilmer Sherf   And a Decln being fild when Said writ Issued forth and —
   a Copy thereof Served therewith according to Act of Assembly in Such
   case made was as folls vizt. Maryland Kent County Ss William Powell late
   of Kent County Platner was attached to Answer unto John Moll of a plea of —
