329 hundred and forty eight each in the penalty of eighteen hundred dollars given on the appeals to the June term of the Court of Appeals for the western shore of Maryland eighteen hundred and forty eight prosecuted in the cases in Anne Arundel County Court of Thomas H Hodges use of Lancelot Warfield against Nicholas B. Worthington and whereas also the said Brice J and the said Chas F united with the same Nicholas B Worthington in the confession of a judgment at the October Term eighteen hundred and forty eight of Anne Arundel County Court in favor of Franklin Sullivan and Patrick H. Sullivan surviving partners of John Sullivan in the sum of nine hundred and fifteen dollars and thirty five cents with interest from the twenty eighth day of September eighteen hundred and forty eight which said sum of money is owing from the said Nicholas B. and the said Brice J and Charles F. Worthington are sureties equally and jointly for the same Now this Indenture witnesseth that in consideration of the premises and for the purpose of securing the said Brice J. Worthington and the creditor of the said Brice J. Worthington contemplated in the deed of trust above mentioned from the said Brice J. to the said Brice R. B. Worthington from all risk charge costs loss and liability for and on account of the jointly liability of the said Charles F. and Brice J. in behalf the debts of the said Charles F. Worthington or of the said Nicholas B. Worthington over and above the share and extent of liability as above particularly mentioned and according to the force tenor and terms of the liabilities as originally understood by and between the parties hereunto and also in consideration of one dollar in hand paid by the said Brice T. B. Worthington to the said Charles F. Worthington hath granted bargained and sold transferred and made over and by these presents doth grant bargain and sell transfer and make unto the said Brice T. B. Worthington his executors administrators and assigns the following negro slaves namely one man named Tom Hanson aged about fifty five years one man named Harry aged about forty five one man Davy Young fifty years of age one woman Liz and three children aged about thirty years one woman Deby aged about twenty years one man David aged about twenty years one boy Jerry aged thirteen years one boy John Wesley aged six years also the following stock three horses two mules three yoke of oxen three milch cows five yearlings thirty sheep twenty hogs and all the farming utensils and implements now in the use and possession of the said Charles F. Worthington in and upon the farm whereon the said Charles is residing called Summer Hill lying and being in Anne Arundel County likewise the crop of wheat in the ground of the said farm Summer Hill and all the household and kitchen furniture in and about the mansion house or residence of the said Charles on the said farm likewise the crop of corn in the corn house crop of Tobacco at present in the Tobacco houses and the barn in the meat house upon the said farm To Have and to Hold the said negro slaves stock cattle farming utensils wheat corn meat unto the said Brice T. B. Worthington his executors administrators or assigns in trust nevertheless for the said purposes and uses as are set forth and declared in the deed from the said Brice J. to the said Brice T. B.
