A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF
CUMBERLAND ENTITLED A RESOLUTION AMENDING THE CHARTER OF
MAYOR AND CITY COUNCIL OF CUMBERLAND (THE "CITY") BY ADDING
SECTION 82B THERETO AUTHORIZING THE CITY TO ACQUIRE REAL,
PERSONAL, OR MIXED PROPERTY BY PURCHASE, GIFT, BEQUEST, DEVISE,
LEASE, LEASE-PURCHASE, INSTALLMENT PURCHASE, OR OTHERWISE;
AUTHORIZING THE CITY TO FINANCE OR REFINANCE THE ACQUISITION OF
REAL, PERSONAL, OR MIXED PROPERTY BY ENTERING INTO CAPITAL
LEASES (AS DEFINED HEREIN) AND PROVIDING THAT THE CITY'S
OBLIGATION TO MAKE PERIODIC PAYMENTS DENOMINATED INTO
PRINCIPAL AND INTEREST UNDER A CAPITAL LEASE SHALL BE
CONTINGENT UPON THE AVAILABILITY OF APPROPRIATED OR OTHER
LEGALLY AVAILABLE FUNDS; AUTHORIZING THE CITY TO PLEDGE OR
ASSIGN THE PROPERTY TO BE ACQUIRED IN WHOLE OR IN PART
PURSUANT TO A CAPITAL LEASE TO SECURE ITS OBLIGATIONS TO MAKE
