The Honorable Michael E. Busch
Speaker of the House
State House
Annapolis, MD 21401
Dear Mr. Speaker:
In accordance with Article II, Section 17 of the Maryland Constitution, today I have
vetoed House Bill 425 - Civil Actions - Liability of Insurer - Failure to Act in Good
Faith.
This bill authorizes the recovery of actual damages, expenses, litigation costs, and
interest in first-party claims against property and casualty insurers under specific
circumstances. It also provides that accrued interest is to be computed at a specified
rate and from a specified date. The clerk of a court will be required to file a copy of
specified verdicts and other dispositions with the Maryland Insurance Administration.
Senate Bill 389, which was passed by the General Assembly and signed by me,
accomplishes the same purpose. Therefore, it is not necessary for me to sign House
Bill 425.
Sincerely,
Martin O'Malley
Governor
