(III) A FINANCIAL PLAN THAT DEMONSTRATES TO THE
SATISFACTION OF THE DEPARTMENT THAT THE EXPANSION WILL NOT HAVE AN
UNREASONABLY ADVERSE EFFECT ON THE FINANCIAL ABILITY OF THE PROVIDER
TO PROVIDE CONTINUING CARE IN ACCORDANCE WITH ITS CONTINUING CARE
AGREEMENTS AND THIS SUBTITLE AT THE FACILITY TO BE EXPANDED AND AT THE
PROVIDER'S OTHER FACILITIES IN THE STATE; AND
(IV) ANY OTHER INFORMATION THAT THE DEPARTMENT REQUIRES.
(C) CONDITIONS FOR APPROVAL.
THE DEPARTMENT SHALL APPROVE AN EXPANSION AND, IF APPROPRIATE,
ISSUE A NEW CERTIFICATE OF REGISTRATION IF THE DEPARTMENT DETERMINES
THAT THE PROPOSED EXPANSION WILL NOT HAVE AN UNREASONABLY ADVERSE
EFFECT ON THE FINANCIAL ABILITY OF THE PROVIDER TO PROVIDE CONTINUING
CARE IN ACCORDANCE WITH ITS CONTINUING CARE AGREEMENTS AND THIS
SUBTITLE.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 70B, § 11(j) and (k).
In subsection (b)(2) of this section, the reference to a "statement of intent"
is substituted for the former references to a "statement that sets forth the
provider's intent" for brevity.
In subsection (b)(4)(iii) of this section, the reference to the facility "to be
expanded" is substituted for the former reference to the facility "identified
in the plan" for clarity.
In subsection (c) of this section, the former reference to an expansion
"requested in accordance with this section" is deleted as surplusage.

10-416. DENIAL, SUSPENSION, OR REVOCATION.
(A) AUTHORIZED.
FOR CAUSE, THE DEPARTMENT MAY:
(1) DENY A FEASIBILITY STUDY APPROVAL; OR
(2) DENY, SUSPEND, OR REVOKE A PRELIMINARY, INITIAL, OR RENEWAL
CERTIFICATE OF REGISTRATION.
