INFORMATION REQUIRED TO BE PROVIDED TO THE DEPARTMENT UNDER THIS
SUBTITLE AND PUBLICIZE THE AVAILABILITY OF THE INFORMATION. (2) (I) A FEASIBILITY STUDY FILED UNDER § 10-408 OF THIS SUBTITLE
MAY NOT BE DISCLOSED UNTIL THE DEPARTMENT ISSUES AN INITIAL CERTIFICATE
OF REGISTRATION FOR THE PROJECT. (II) INFORMATION REQUIRED TO BE PROVIDED UNDER §
10-434(B)(2) OF THIS SUBTITLE SHALL BE DISCLOSED ONLY TO THE EXTENT
REQUIRED UNDER THE PUBLIC INFORMATION ACT. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 70B, §§ 8 and 11(1). In the introductory language and in item (1) of subsection (a) this section,
the phrase "[t]he Department shall ... administer this subtitle" is
substituted for the introductory language of former Art. 70B, § 8, which
provided "[t]he administration of this subtitle is vested in the Department"
for clarity and consistency in the enumerated duties of the Department. In subsection (a)(3) of this section, the former reference to filing fees
"established for" is deleted as redundant in light of the requirement that
the Department "establish" filing fees. In subsection (b)(1) of this section, the reference to information required to
be provided "to the Department" is added for clarity. In subsection (b)(2)(i) of this section, the phrase "may not be disclosed" is
substituted for the former phrase "which shall be confidential" for clarity. In subsection (b)(2)(ii) of this section, the former phrase "[p]aragraph (1) of
this subsection does not apply" is deleted as unnecessary in light of the
phrase "[e]xcept as provided in paragraph (2) of this subsection" in
subsection (b)(1) of this section. Defined terms: "Department" § 10-101
"Person" §§ 1-101, 10-401 10-404. PAYMENT FOR HEALTH RELATED SERVICES. MEDICAL AND NURSING SERVICES AND OTHER HEALTH RELATED SERVICES
MAY BE COVERED BY AN ENTRANCE FEE OR PERIODIC CHARGES OR AT THE OPTION
OF THE SUBSCRIBER, MAY BE PURCHASED FOR AN ADDITIONAL FEE. REVISOR'S NOTE: This section formerly was Art. 70B, § 7A. No changes are made. Defined terms: "Entrance fee" § 10-401
