OF THE OFFICE OF THE ATTORNEY GENERAL ESTABLISHED UNDER TITLE 6,
SUBTITLE 4 OF THE STATE GOVERNMENT ARTICLE. (D) SPECIAL PROGRAMS. IN EACH FACILITY, THE DEPARTMENT SHALL DEVELOP SPECIAL PROGRAMS
THAT ARE DESIGNED TO MEET THE PARTICULAR NEEDS OF ITS RESIDENTS. (E) CHANGES IN POLICY, CONDUCT, AND MANAGEMENT. SUBJECT TO TITLE 3, SUBTITLES 8 AND 8A OF THE COURTS ARTICLE, THE
DEPARTMENT SHALL ORDER ANY NECESSARY CHANGES IN THE POLICY, CONDUCT,
OR MANAGEMENT OF A STATE RESIDENTIAL PROGRAM TO PROVIDE ADEQUATE CARE
FOR THE CHILDREN AND ADEQUATE SERVICES TO THE COURTS. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 83C, § 2-118(a) through (f). In subsections (b)(3)(i) and (d) of this section, the references to a facility's
"residents" are substituted for the former references to its "population" for
clarity. In subsection (b)(3)(v) of this section, the former reference to "programs
that ensure" a safe, humane, and caring environment is deleted as
surplusage. In subsection (c)(1) of this section, the requirement that the Department
adopt a policy "to govern" disciplinary actions and grievances is
substituted for the former requirement that the Department adopt a policy
"for addressing" disciplinary actions and grievances for clarity. In subsection (c)(2)(i) of this section, the reference to any grievance "made
by or on behalf of a child" is added for clarity. Defined term: "Department" § 9-101 9-228. STATE FACILITIES — BOND REQUESTS. BEFORE THE DEPARTMENT REQUESTS A BOND ISSUE FROM THE GENERAL
ASSEMBLY TO BUILD OR RENOVATE A FACILITY, THE DEPARTMENT SHALL CONSULT
ON THE PROPOSED CONSTRUCTION OR RENOVATION PLANS WITH THE GOVERNING
BODY OF: (1) THE COUNTY WHERE THE FACILITY IS TO BE BUILT OR RENOVATED; AND (2) EACH COUNTY TO BE SERVED BY THE FACILITY. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 83C, § 2-117(b). In item (2) of this section, the reference to each county to be served "by the
facility" is added for clarity.
