8-802. SCOPE OF SUBTITLE. THIS SUBTITLE APPLIES TO A CORPORATION THAT IS AN APPLICANT FOR OR
HAS BEEN GRANTED A LICENSE TO OPERATE A RESIDENTIAL CHILD CARE PROGRAM
IN THE STATE. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 49D, § 6-101(a)(2). It is revised as a scope provision rather than as a definition of
"corporation" for clarity. The former reference to "an entity with articles of incorporation" is deleted
as implicit in the reference to a "corporation". Defined term: "Residential child care program" § 8-101
8-803. LICENSING REQUIREMENTS — IN GENERAL. EXCEPT AS PROVIDED IN § 8-807 OF THIS SUBTITLE AND IN ADDITION TO THE
STANDARDS SET FORTH IN COMAR 14.31.06 AND 14.31.07, A CORPORATION SHALL
MEET THE REQUIREMENTS ESTABLISHED IN THIS SUBTITLE AS A CONDITION OF
LICENSURE. REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 49D, § 6-101(b). The phrase "[e]xcept as provided in" is substituted for the former phrase
"[notwithstanding the provisions of" for clarity. 8-804. REQUIRED DOCUMENTATION. A CORPORATION SHALL DEMONSTRATE TO THE LICENSING AGENCY THE
CAPABILITY TO PROVIDE FOR AND ARRANGE FOR THE PROVISION OF ALL
APPLICABLE SERVICES PROPOSED IN THE LICENSE APPLICATION BY SUBMITTING,
AT A MINIMUM, THE FOLLOWING DOCUMENTS TO THE LICENSING AGENCY: (1) A BUSINESS PLAN THAT CLEARLY DEMONSTRATES THE ABILITY OF
THE RESIDENTIAL CHILD CARE PROGRAM OPERATED BY THE CORPORATION TO
PROVIDE SERVICES IN ACCORDANCE WITH STATE REGULATIONS AND FUNDING
REQUIREMENTS; (2) A SUMMARY OF THE CORPORATION'S DEMONSTRATED EXPERIENCE
IN THE FIELD OF HUMAN SERVICES, IN ACCORDANCE WITH STANDARDS DEVELOPED
BY THE OFFICE; (3) PRIOR LICENSING REPORTS ISSUED WITHIN THE PREVIOUS 10 YEARS
CONCERNING THE CORPORATION OR ANY IN-STATE OR OUT-OF-STATE ENTITIES
ASSOCIATED WITH THE CORPORATION OR THE RESIDENTIAL CHILD CARE PROGRAM,
INCLUDING DEFICIENCY REPORTS AND COMPLIANCE RECORDS ON WHICH THE
STATE MAY MAKE REASONED DECISIONS ABOUT THE QUALIFICATIONS OF THE
CORPORATION OR THE RESIDENTIAL CHILD CARE PROGRAM; AND (4) A WRITTEN QUALITY ASSURANCE PLAN, APPROVED BY THE
