(i) Is unconstitutional;
(ii) Exceeds the statutory authority or jurisdiction of the
Department;
(iii) Results from an unlawful procedure;
(iv) Is affected by any other error of law;
(v) Is unsupported by competent, material, and substantial
evidence in light of the entire record as submitted; or
(vi) Is arbitrary or capricious.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2007.

AN ACT concerning
Oil Pollution and Tank Management
FOR the purpose of altering the definition of oil to include ethanol and any edible oils
intended to be used as a motor fuel or fuel source biodiesel fuel: requiring an
underground storage facility to be in substantial compliance with Maryland law
and regulations before selling oil to the facility or receiving oil at the facility;
and generally relating to oil pollution and tank management.
