REVISOR'S NOTE: This section is new language derived without substantive
change from former SG § 9-1119(h). Defined term: "Advisory Committee" § 7-135 SUBTITLE 2. RESPITE CARE FOR INDIVIDUALS WITH DEVELOPMENTAL OR
FUNCTIONAL DISABILITIES. 7-201. DEFINITIONS. (A) IN GENERAL. IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS INDICATED. REVISOR'S NOTE: This subsection is new language added as the standard
introductory language to a definition section. (B) DEPARTMENT. "DEPARTMENT" MEANS THE DEPARTMENT OF HUMAN RESOURCES. REVISOR'S NOTE: This subsection is new language added to avoid repetition
of the full reference to the "Department of Human Resources". (C) RESPITE CARE. "RESPITE CARE" MEANS SHORT-TERM CARE: (1) OF AN INDIVIDUAL WITH A DEVELOPMENTAL OR FUNCTIONAL
DISABILITY DESCRIBED UNDER § 7-202 OF THIS SUBTITLE; AND (2) THAT IS PROVIDED EITHER WITHIN OR OUTSIDE THE INDIVIDUAL'S
HOME TO GIVE TEMPORARY RELIEF TO THE INDIVIDUAL OR THE INDIVIDUAL'S
FAMILY. REVISOR'S NOTE: This subsection is new language derived without
substantive change from former Art. 88A, § 128(a), as it related to
individuals with developmental or functional disabilities. The reference to a disability "described under § 7-202 of this subtitle" is
added for clarity. 7-202. INDIVIDUALS WITH FUNCTIONAL OR DEVELOPMENTAL DISABILITIES.
(A) FUNCTIONAL DISABILITY. AN INDIVIDUAL HAS A FUNCTIONAL DISABILITY IF THE INDIVIDUAL HAS A
SEVERE, CHRONIC DISABILITY THAT: (1) IS ATTRIBUTABLE TO A MENTAL OR PHYSICAL IMPAIRMENT OR A
COMBINATION OF MENTAL AND PHYSICAL IMPAIRMENTS, INCLUDING A HEAD
INJURY; (2) IS LIKELY TO CONTINUE INDEFINITELY;
