(12) TWO REPRESENTATIVES OF LOCAL GOVERNMENT IN AREAS WITH A
SIGNIFICANT NUMBER OF NONCUSTODIAL FATHERS; AND
(13) ONE NONCUSTODIAL FATHER
(B) TENURE.
(1) THE TERM OF A MEMBER APPOINTED UNDER SUBSECTION (A)(10),
(11), OR (12) OF THIS SECTION IS 3 YEARS.
(2) THE TERM OF THE MEMBER APPOINTED UNDER SUBSECTION (A)(13)
OF THIS SECTION IS 2 YEARS.
(3) THE TERMS OF MEMBERS APPOINTED UNDER SUBSECTION (A)(10),
(11), (12), AND (13) OF THIS SECTION SHALL BE STAGGERED AS REQUIRED BY THE
TERMS IN EFFECT FOR THOSE MEMBERS ON OCTOBER 1, 2007.
(4) A MEMBER WHO IS APPOINTED TO A POSITION WITH A FIXED TERM
AFTER THE TERM HAS BEGUN SHALL SERVE ONLY FOR THE REST OF THE TERM AND
UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.
(5) AT THE END OF A TERM, A MEMBER CONTINUES TO SERVE UNTIL A
SUCCESSOR IS APPOINTED AND QUALIFIES.
(C) DESIGNEES.
A MEMBER APPOINTED UNDER SUBSECTION (A)(1) THROUGH (6) OF THIS
SECTION MAY DESIGNATE IN WRITING AN ALTERNATE TO REPRESENT THE MEMBER
AND EXERCISE THE MEMBER'S POWER TO VOTE.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 41, §§ 18-403(a) and (b) and 18-404(b).
In subsection (a)(6) of this section, the reference to the "Executive Director
of the Governor's Office for Children" is substituted for the former obsolete
reference to the "Special Secretary of the Office for Children, Youth, and
Families".
In subsection (a)(10) and (11) of this section, the reference to "individuals"
is substituted for the former reference to "persons" because only
individuals, and not the other kinds of entities included in the defined
term "person", can be members of the Commission. See § 1-101 of this
article.
In subsection (b)(3) of this section, the reference to the terms on "October 1,
2007" is new language added for clarity. This addition is not intended to
alter the term of any member of the Commission. See § 11 of Ch. 3, Acts of
2007. The terms of the members serving on October 1, 2007 end as follows:
(1) 4 on September 30, 2008; (2) 3 on September 30, 2009; and (3) 2 on
September 30, 2010.
In subsection (b)(4) of this section, the reference to the "qualifi[cation]" of a
successor is added for conformity with standard language.
